from the determination of the Building Inspector involving the premises at 551/553 Lake Ave in the City of
Saratoga Springs,New York being tax parcel number 167.-1-77.12/.13 on the Assessment Map of said City.
The applicant having applied for an area variance under the Zoning Ordinance of said City to permit the
construction of an accessory structure with a finished space in a Rural Residential(RR)District and public notice
having been duly given of a hearing on said application held on the 1st and 22nd days of February, 2021.
In consideration of the balance between benefit to the applicant with detriment to the health, safety and welfare
of the community, I move that the following area variance for the following amount of relief:

As per the submitted plans or lesser dimensions,be approved for the following reasons:
1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant.
The applicant is aware that building a second principal structure is permitted and would eliminate the need
for a variance. However, the applicant notes that converting the existing structure to a second principal
structure would require significant additional construction work to be performed at considerable expense in
order to receive a certificate of occupancy from the city. The applicant intends to utilize the accessory
structure for vehicle maintenance and exercising. The applicant is seeking a temperature controlled space
with a full bath to more effectively meet their intended use.
2. The applicant has demonstrated that granting this variance will not create an undesirable change in
neighborhood character or detriment to nearby properties. The board notes that two properties have been
combined in the Rural Residential area with enough lot size to permit two principal structures. Also, the
accessory structure already exists, and the applicant notes that granting this variance will not alter the
exterior appearance.
3. The Board notes the requested variance of 100%is considered substantial; however this is mitigated by the
points discussed in paragraph 2. The board finds the situation laid out in the resolution to be unique due to
the large lot size in the RR zoning district, costs of converting to a principal structure, and minimal
modifications to the exterior of existing structure.
4. This variance will not have a significant adverse physical or environmental effect on the neighborhood or
district. The accessory structure already exists well within zoning setbacks and parameters, and the exterior
will not be significantly modified per the submitted plans.
5. The alleged difficulty is considered self-created insofar as the applicant desires to finish the space in the
accessory structure. However, this is not necessarily fatal to the application

This variance shall expire 18 months following the filing date of such decision unless the necessary building
permit has been issued and actual construction begun as per 240-8.5.1.
I hereby certify the above to be a full,true and correct copy of a resolution duly adopted by the Zoning Board of
Appeals of the City of Saratoga Springs on the date above mentioned, seven members of the Board being
present.
