DINES 37-39 ASH ST. SARATOGA SPRINGS NY 12866 from the determination of the Building Inspector involving the premises at 35 Ash St(Lot 1)in the City of Saratoga Springs, New York being a subdivided new parcel, formerly a component of parcel number 165.74-2-16, in an Urban Residential-3 district on the Assessment Map of said City. This being an application for an area variance under the Zoning Ordinance of said City to permit the construction of a one-family residence and public notice having been duly given of a hearing on said application held on the 1st day of February 2021. In consideration of the balance between benefit to the applicant with detriment to the health, safety and welfare of the community, I move that the following area variances for the following amounts of relief: TYPE OF REQUIREMENT DISTRICT PROPOSED RELIEF REQUESTED DIMENSIONAL REQUIREMENT MAXIMUM ACCESSORY BUILDING 10% 13.2% 3.2%OR 32%RELIEF COVERAGE FINISHED SPACE IN ACCESSORY NOT PERMITTED PERMITTED 100% STRUCTURE As per the submitted plans or lesser dimensions,be approved for the following reasons: 1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant. Per the applicant, the size requested is the minimum needed to accommodate a standard 2 car garage, plus interior stairs, plus 18" overhangs required to mirror the architecture of the principal structure. The Board notes that the current proposal is a revision of the original,and brought down after feedback from the Board on accessory coverage. 2. The applicants have demonstrated that granting these variances will not create an undesirable change in neighborhood character or detriment to nearby properties. The applicant noted that due to the nature of their work, the combination of the need for office space, quiet areas to do the work required, and the limitations of the capacity of the house, a separate office space in the accessory is needed. The applicant further notes neighborhood context, demonstrating for the Board that there are numerous other garages and carriage houses in the immediate area. 3. The Board notes the requested variances are substantial,however the impact of the substantiality is mitigated by the lack of impact noted above, and conditions listed below. The Board further notes that for the lot coverage variance,the combination of principal plus accessory coverage is 40.2%,which is a minor increase over the total 40%allowed for the district. 4. This variance will not have a significant adverse physical or environmental effect on the neighborhood or district. The application shows greater than required 15%permeability. 5. The alleged difficulty is self-created insofar as the applicant's desire to construct the proposed residence, but this is not necessarily fatal to the application. Conditions: 1. For the accessory structure finished space,no kitchen facilities,nor bathing facilities and no overnight stays. 2. For the principal structure,no further additions to principal coverage without a variance. Adopted by the following vote: AYES: 7 (K. Kaplan, B. Gallagher, T. Gallogly, C. Grey, M. Gutch, R. Simpson) NAYE S: 0 Dated: February 1, 2021 This variance shall expire 18 months following the filing date of such decision unless the necessary building permit has been issued and actual construction begun as per 240-8.5.1.
