Whether the benefit sought by the applicant can be achieved by other feasible means. Identify what alternatives to the variance have been explored (alternative designs, attempts to purchase land, etc.) and why they are not feasible. Firstiv, the benefits of placinq the parkinq area within the required setback cannot be achieved bv anv other means, for two main reasons. The first beinq the wetlands on site� which necessitate that the maioritv of the parkinq sqaces be located along Driscoll Road so that no wetlands are disturbed at the rear and interior side of the site. The second beinq the overail dimensions of the lot combined with the larqe number of parkinp spaces required; due to the Citv Code's requirements for the proposed use the number of parkinq spaces simplv cannot fit within reasonable proximitv to the buildinq without beinq within the setback. Secondlv, the benefits of installinq three (3) freestandinq siqns on the propertv cannot be achieved bv anv other means, for one main reason; the position and topoqraphv of the lot. This is a corner lot and the IoYs topoqraphv dictates that the main entrance to the site is located off Driscoll Road weil awav from the main road (South Broadwav). The applicant needs the ability to have siqnaqe for her business and tenants both visible from the main road, and at the actual site and business entrance. 2. Whether granting the variance will produce an undesirab�e change in the character of the neighborhood or a detriment to nearby properties. Granting the variance will not create a detriment to nearby properties or an undesirable change in the neighborhood character for the following reasons: Neither variance will produce an undesirable chanqe in the character of the neiqhborhood or cause a detriment to nearbv properties. The parkinq area as proposed still leaves approximatelv 25' of separation between itself and Driscoll Road. This buffer will be supplemented with additional street trees and landscapinq to provide an attractive frontage for the site. The two (2) main proposed freestandinq siqns are located approximatelv 300' awav from each other (with the third smaller siqn beinq another 60' awav) and will not create an overabundance of siqnaqe� the addition of the second and third signs are onlv meant to improve the recoqnizabilitv of the site for drivers on both South Broadwav and Driscoll Road Revised 01/2019 ZONING BOARD OF APPEALS APPLICATION FORM PaGE 7 3. The requested variance is not substantial for the following reasons: The variances are not substantial because thev are not in discord with the overall qlanninq qoals for the Tourist Related Business Zone. The applicant's proposal will create a modern and attractive site which despite the requested variances, will stili be harmonious with the surroundinq area. 4. Whether the variance will have adverse physical or environmental effects on neighborhood or district. The requested variance will not have an adverse physical or environmental effect on the neighborhood or district for the following reasons: Neither variance will have anv adverse physical or environmental effects on the neiqhborhood or zoninq district. The intent of placinq the qarkinq area within the reauired setback actuallv stems from the desire to preserve as much of the existinq natural landscape as possible Bv locatinq the parkinq area near the Driscoil Road frontaae, the existinq topoqraphv adiacent to South Broadwav— alonq with the wetland areas in the middie of the site — can be preserved. The addition of the second and third freestandinq signs will not have an additional environmental impact either as that area will alreadv be developed 5. Whether the alleged difficulty was self-created (although this does not necessarily preclude the granting of an area variance). Explain whether the alleged difficulty was or was not self-created: The alleqed difficulties are, for the most part, not self-created� only in the sense that the applicant wishes to fulfili their development qoals. The parking requirements are set forth by the Citv Code and dictate that a fairlv larqe number of parkinq spaces are provided. The wetlands on site (protected at the request of the Pianninq Board) cannot be disturbed which would otherwise allow the required parkinq spaces to be located outside the required setback area The position and topoqraphy of the lot are existinq conditions and these factors are what necessitate the additional freestandinq siqns where onlv one is normallv allowed.
