The plans are in conformance with the plans that received a SEQRA negative declaration and preliminary approval from the Board on July 30th of this year. The minor revisions are based on final technical comments from Chazen and City Staff. The final application form and fee were transmitted to the City on April 9th of this year. The overall project site contains 78.87 acres of land with road frontage on either side of Kaydeross Avenue East. See Figure 1, Site Location Map. This document has been prepared to meet Article IV of the City of Saratoga Springs Subdivision Regulations regarding Conservation Subdivisions, more specifically Article IV Section C(2)I that requires preparation of a land management plan. The lands that are within the Project and that are the subject of this Management Plan are indicated on Figure 2, Land Management Plan Components. The Plan covers two separate tax parcels: Parcel 1 and Parcel 2. The open space lands will be owned by the owners of Lot's 1, 11 and Lot 15 and are proposed to be managed by the City of Saratoga Springs when public access is desired. The subject property includes two separate parcels divided by Kaydeross Avenue East. The West parcel (Parcel 1), is approximately 34.4 acres with an existing single-family residence (home address no. 227), barn and driveway with ingress/egress to Kaydeross Avenue East. The second parcel (Parcel 2) is approximately 44.5 acres of undeveloped land located on the East side of Kaydeross Avenue East, across from the southeast corner of the Western parcel. Both parcels are predominately forested and include areas of State and Federal jurisdictional wetlands bordering on perennial tributaries to Kayderosseras Creek. A proposed trail system will be developed on Parcel 1 with the ability to extend the trail through Parcel 2 and make further connections to neighboring properties. The trail will have a natural surface similar to the Hemlock Trail located off of Crescent Avenue and is envisioned to be part of a more extensive trail system through neighboring properties as they develop in the future. Conservation Features associated with Parcels 1 and 2 are listed on the following pages and referenced on the attached Conservation Analysis Plan (Figure 7). 1.1 Goals for the Management Plan Lands The project site parcels are zoned RR-1 by the City of Saratoga Springs Zoning Ordinance. The Ordinance states that the district intent is to provide for low density residential and agricultural uses in order to preserve open space and a rural character. Conservation subdivision design is required for all properties in the Rural Residential Zone for open space conservation and natural resource protection. The project site is also located in an area identified in the 2015 City of Saratoga Springs Comprehensive Plan as a Conservation Development District(CDD) which reflects the "Country"of the City in the Country. The parcels are also within the "Country Overlay Area" where; the use of conservation subdivision design is intended to preserve tracts of environmentally and scenically significant undeveloped land including road corridors and buffers, in order to maintain the historic settlement pattern and implement the Comprehensive Plan's vision of a "City in the Country. " 1 SECTION 2.0 INVENTORY 2.1 Parcel 1 Conservation Features 2.1.1 State Wetlands (NYS DEC) Pursuant to the New York State Department of Conservation (DEC)Environmental Mapper and field delineation, there is an area of approximately 0.01 acres of the100 foot wetland adjacent area to DEC Wetland Q-11, located in the northwest corner and approximately 0.69 acres at the southeast corner of the parcel. The adjacent areas provide a buffer that is intended to protect Wetland Q11 and the wildlife habitat it provides from stormwater pollution, erosion and sedimentation. 2.1.2 Federal Wetlands (ACOE) There is a Class C Stream that is perennial and has a hydrologic connection or significant nexus with a headwater forested wetland that is approximately 1.70 acres located in the south west quadrant of the parcel. The stream flows northeast and is bordered by the forested wetland for approximately 1,220 linear feet and into an emergent wetland (i.e. persistent herbaceous vegetation)that is approximately 2.15 acres located in the northeast quadrant of the parcel. There is also a forested wetland, approximately 0.69 acres, located in the southeast quadrant of the parcel with a significant nexus to DEC wetland Q-11 located on the east side of Kaydeross East Ave. This palustrine wetland system is regulated by the ACOE under Section 404 of the Clean Water Act and provides valuable wildlife habitat and stormwater attenuation and filtration. These wetland areas are connected to wetland Q-11 by two (2) culverts which were constructed under Kaydeross Avenue East. 2.1.3 Stream Corridors There is a perennial DEC Class C Stream (ID# 941-127.1)that is not regulated by the NYS DEC because it is not capable of supporting trout. The stream is approximately 1,220 linear feet and conveys the flow of groundwater and stormwater runoff from the southwest corner of the parcel to the northeast corner of the property. There is an existing tractor path that crosses the stream located near the middle of Parcel 1. 2.1.4 Other Water Bodies There is a manmade pond located adjacent to the west side of the detached garage that provides wildlife habitat. The pond does not have a defined nexus to the wetland systems referenced above, therefore, it is isolated and not regulated by the NYS DEC or ACOE. 2.1.5 Floodplains (100 Year) There is a small area of Federal Emergency Management Agency (FEMA), 100 Year Flood Zone located in the northwest corner of the parcel which is contiguous with the floodplain on neighboring properties that provides floodwater storage during significant storm events. 2 2.1.6 Water Resource Protection Areas Pursuant to the New York State Department of Environmental Conservation (NYS DEC) Environmental Mapper, there is an area of approximately 0.01 acre of the100 foot wetland adjacent area to DEC Wetland Q-11, located in the northwest corner and approximately 0.69 acres in the southeast corner of the parcel. The adjacent areas provide a buffer that is intended to protect Wetland Q11 from stormwater pollution, erosion and sedimentation. 2.1.7 Steep Slopes This parcel has two areas with slopes greater than 25%, approximately 1.10 acres in the north west quadrant of the site and approximately 0.23 acre in the center of the site bordering the perennial stream. These areas have soils that consist of well drained channery silt loam consistent with the Natural Resources Conservation Service's Bernardston Silt Loam (BmD) soil series and are vegetated with mature forest consisting of broad leaved deciduous trees and shrubs including White Oak(Quercus alba), Quaking Aspen (Populus tremuloides), and Black Cherry (Prunus serotine) that stabilize these slopes and protect against soil erosion. There was no evidence of erosion during our investigation of these slopes. 2.1.8 Wooded Areas There is a late successional, mixed deciduous coniferous forest that occupies approximately 31.4 acres of the parcel, extending west from the landscaped area surrounding the single family residence and wetland fronting Kaydeross Avenue East. Tree species in this forest include White Oak(Quercus alba), Quaking Aspen (Populus tremuloides), Black Cherry (Prunus serotine), American Hophornbeam (Ostrya virginiana), Shagbark Hickory (Carya ovata), Green Ash (Fraxinus pennsylvanica), Eastern Hemlock(Tsuga canadensis) and White Pine (Pinus strobus). This forested is typical of forested areas in the region. There is one uncommon White Oak(Quercus alba)tree that is approximately 6 feet in diameter located close to the middle of the parcel, located on Figure 2 and shown in an attached photograph. The impact of clustering on tree removal was discussed by the City of Saratoga Springs Planning Board and a limited tree survey was requested within the proposed development areas of Parcel 1. On March 6 through March 8, 2019, a survey was conducted to locate tree clusters with trees greater than 10 diameter(inches) at breast height(dbh)within Development Areas A and B shown on the attached tree survey map (Figure T-1). Methods involved walking transects approximately 20 feet wide identifying tree species and taking GPS waypoints of approximate boundaries of tree clusters. The tree clusters and dominant species within each cluster are shown on the Figure T-1, identified with an alphanumeric reference that corresponds to attached photographs of each cluster(i.e. Al —Hemlock/Aspen/Pine). Tree species that were identified within the development areas include; Black Birch (Betula lenta), Black Cherry (Prunus serotine), Eastern Hemlock(Tsuga canadensis), Large Tooth Aspen (Populus grandidentata), Red Maple (Acer rubrum), Red Oak(Quercus borealis), Shag Bark Hickory (Carya ovata), Sugar Maple (Acer saccharum), White Ash (Fraxinus 3mericana), White Oak(Quercus alba), White Pine (Pinus strobus). The clusters of trees within the development areas are described below. 3 Development Area A Tree Clusters: Development Area A is located in the northwest quadrant of the site, accessible via a tractor path that extends to the location from the existing farmhouse. This area includes trees greater than 10 dbh, primarily Eastern Hemlocks located within the northern half of the area proposed for development, surrounded by clusters of mixed deciduous species. There are a large number of trees greater than 10 dbh in Development Area A, primarily within the cluster of Hemlock trees (Al) and within the cluster of Aspen, Hickory and Maple trees (A7)in the northeastern portion of the area. Therefore each individual tree was not located, only predominate clusters. The same method was used with a stand of Pine trees (A6) and Norway Spruce trees (A8)located southeast of the Hemlocks (Al). A large majority of the trees greater than 10 dbh within Clusters A2, A4 and A5 are shown on Figure T-1. Cluster A3 consists of early successional Maple trees that are less than 10 dbh. The list of clusters provided below corresponds to Figure T-1 and photographs within Attachment 2. • Al —Hemlock with random Pine and Aspen, approximately 70 feet tall, between elevation +/-270 and 280 feet above sea level • A2 —Oak, approximately 70 feet tall, at elevation +/-280 • A3 — Successional Maple, approximately 30 feet tall, at elevation+/-270 • A4 —Maple, approximately 70 feet tall, at elevation+/-270 • A5 —Oak and Hickory, approximately 70 feet tall, at elevation+/-250 • A6 —Pine, approximately 70 feet tall, at elevation +/-270 • A7 —Aspen, Maple, and Hickory, approximately 70 feet tall, at elevations between +/- 250 and+/-280 • A8 —Spruce, approximately 70 feet tall, at elevation +/-250 Development Area B Tree Clusters: Development Area B is located in the southwest quadrant of the site, also accessible via the tractor path that extends to the development areas from the existing farmhouse. This development area is dominated by a cluster of shrubs (B1)that occupies the majority of the western half of the development area. Shrubs within this area include Japanese Honey Suckle (Lonicera japonica), European Buckthorn (Rhamnus frangula), Oriental Bittersweet (Celastrus orbiculate), and Japanese Barberry (Berberis thunbergii). Cluster B2 is located in the northeast portion of the area and includes several Aspen, Oak, and Maple trees. This is also the Cluster that includes the large "Colonial Oak" that is approximately 60 dbh, equal to a circumference of approximately 15 feet. Cluster B3 is a mid-successional stand of Birch, Maple and Ash trees located in the southeast portion of the area surrounding several Pine trees. Cluster B5 is located in the southwestern portion of the area and includes several Oak, Maple and Ash trees. The list of clusters provided below corresponds to the Tree Survey map and photographs within Attachment 2. • B1 — Shrubs approximately 15 feet tall, at elevation+/-250 • B2— Oak, Maple, Aspen approximately 70 feet tall, at elevation +/-250 • B3 —Late Successional Birch, Maple, and Ash, approximately 30 feet tall, at elevation +/-250 • B4—Pine, approximately 70 feet tall, at elevation +/-250 4 • B5 — Oak, Maple, Ash, 70 feet tall, at elevation +/-250 The tree survey results show that Development Area A is predominately a mixed deciduous coniferous forest with a dominate Hemlock stand that occupies the majority of the northern half of the area, surrounded by clusters of Oak, Maple, Aspen, Pine and Hickory trees. The average height of the tree canopy is approximately 70 feet. Development Area B is dominated by a cluster of shrubs that occupies the majority of the western half of the development area surrounded by clusters that include a mix of and late successional deciduous trees. These forest types are considered mid successional. 2.1.9 Cultural History A Phase 1 Archaeological Survey was completed for the developable area by Curtin Archaeological Consulting, Inc. Six archaeological sites were identified, all within parcel 1, and all will be avoided within the conservation area. The areas are indicated on Figure 4. Two of the sites are overlapping and therefore there are five areas archaeological significance indicated on the plan. These areas include a 25-foot buffers around the artifact find spots. The Kaydeross Ave Historic site includes the existing house which is required to be saved and restored by a perspective home buyer. The house was reportedly moved to the current location. The precise timing is unknown, but the house location can be found on a map created in 1856. The Saratoga Springs Preservation Foundation also dated the house in the 1850's and occupied by Lorenzo Riley. The remainder of the sites were considered having precontact period artifacts consisting of chert and/or flakes, one piece of fire-cracked rock and a chopper. As stated, these areas will be avoided and included in the conservation area. 2.1.10 Hedgerows and Stonewalls There are no hedgerows located on Parcel 1. There are 4 stone walls, two are in good condition located in the southwest quadrant. The other two walls were eroded and had collapsed in many places. One is parallel with a portion of the north property boundary and the other is parallel with the south property boundary. The walls provide a property reference and wildlife habitat. Photographs of these walls can be found in Site Photographs, Attachment 1. 2.1.11 Viewsheds from Public Roads A portion of Parcel 1 lies in an Agricultural Heritage Area within the City of Saratoga Springs Open Space Resources Plan (2002). As stated in the Plan, "The City of Saratoga Springs has a rich agricultural heritage, with some farms still operating today. In other places the City's agricultural past is evident in the landscape where old farm buildings and fallow fields remain." Recommended actions for these areas include protecting them within a conservation easement as a primary option. Preservation of this area within a conservation easement has a high value given the fact that it is a recommended action within the Plan. The tree line bordering Kaydeross Avenue East and the forested area surrounding the house and landscaped area screens a large portion of the property from view. The only view of the property from Kaydeross Avenue East is in the proximity of the driveway and single family residence. There are no views of the Parcel from any other public roads, trails or parks. 5 Viewsheds toward Parcel 1, analyzing the impacts of tree clearing associated with the proposed development, were further studied as requested by the City of Saratoga Springs Planning Board. On March 8, 2019, 32mm and 53mm photographs were taken from two locations referenced by the Planning Board. The first photo was from the south bound lane of Kaydeross Ave East looking west into the site,just south of the farmhouse. The second location was from the Crescent Avenue Bridge looking east toward the ridge at the northwest corner of the site. Please refer to the Viewpoint Location Map (Figure V-1) under Attachment 3 showing the photo locations. The approximate area of clearing (Indicated as "clear cut" for conservative purposes) associated with developing the proposed conservation subdivision shown on Figure V-1 was superimposed over each photographic image using the Photoshop program. Photo locations and approximate clearing areas are shown on the Figure V-1, followed by the visual simulations within Attachment 3. The visual simulations show that clear cutting the development areas will be screened from view from Kaydeross Ave East looking west into the site and from the Crescent Avenue Bridge looking east toward the ridge at the northwest corner of the site. It should be noted that clear cutting is not proposed but utilized as a worst case scenario for analysis. 2.2 Parcel 2 Conservation Features 2.2.1 State (NYS DEC) and Federal (ACOE) Wetlands There is an area of approximately 41 acres of ACOE and DEC wetland. The wetland is identified by the DEC as Wetland Q-11, a Class I wetland with an associated 100 foot wetland adjacent area that occupies the majority of this parcel. Lonely Creek borders the entire length of the eastern property and has a significant nexus/hydrologic connection to DEC Wetland Q-11. The wetland also contributes to the hydrology of an unnamed DEC Class C perennial stream that extends across the middle of Parcel 2 and flows into Lonely Creek. This wetland system is regulated by both the DEC and ACOE and the 100-foot adjacent area is regulated only by the DEC. Both the wetland and adjacent area provide valuable wildlife habitat and protection from stormwater pollution, erosion and sedimentation and has a high conservation value. 2.2.2 Stream Corridors Lonely Creek borders the entire length of the eastern property for approximately 2,150 linear feet and there is an unnamed perennial tributary to Lonely Creek that crosses the middle of the parcel for approximately 1,528 linear feet. Both of these streams are DEC Class C streams with the same DEC ID: No. 941-127.1. 2.2.3 Floodplain (100 Year) There is approximately 42 acres of the Federal Emergency Management Agency (FEMA) 100 Year Flood Zone located on Parcel 2 that provides floodwater storage during significant storm events and also has high conservation value because of the protection that it provides. 6 2.2.4 Water Resource Protection Areas There is an area of approximately 1.5 acres of 100-foot wetland adjacent area to DEC Wetland Q-11, located in the northwest corner of the parcel. The adjacent area provides a valuable buffer that is intended to protect Wetland Q11 from stormwater pollution, erosion and sedimentation. 2.2.5 Wooded Areas The East Parcel is predominately forested with species including Red Maple (Acer rubrum), Swamp White Oak(Quercus bicolor), Black Ash (Fraxinus nigra), that provide wildlife habitat, erosion control and flood protection during storm events. 2.2.6 Cultural History A Phase 1 Archaeological Survey was completed by Curtin Archaeological Consulting, Inc. and addressed the developable area of Parcel 2. No areas of archaeological significance were found within the developable area of parcel 2. 2.2.7 Viewsheds from Public Roads A portion of Parcel 2 lies in an Agricultural Heritage Area within the City of Saratoga Springs Open Space Resources Plan (2002). As stated in the Plan, "The City of Saratoga Springs has a rich agricultural heritage, with some farms still operating today. In other places the City's agricultural past is evident in the landscape where old farm buildings and fallow fields remain." Recommended actions for these areas include protecting them within a conservation easement as a primary option. A majority of the frontage will remain undisturbed except for the construction of a residential driveway and one home on the southern-most area of the parcel. 2.3 Legal Information 2.3.1 Deeds, Leases, Management Agreements At this time, there are no separate deeds for the open space lands. However, lots which contain the open space lands are shown on the Subdivision Plat submitted to the City Planning Board. Metes and bounds descriptions of the parcels have been and are included in Attachment 4. Once the subdivision is approved, deeds for lots, including the open space lots, will be created. 2.3.2 Insurance Coverage Insurance coverage over the deed restricted lands will be held by the individual lot owners (Lots 1, 11 and 15)until a time when the City of Saratoga Springs desires public access and insurance responsibilities will be transferred to the City. 7 2.3.3 Conservation Easements/Deed Restrictions A draft conservation easement has been developed and is included as Attachment 5. 2.3.4 Survey Map A copy of the Subdivision Plat that includes Parcel 1 and Parcel 2 is included in Attachment 6. This Subdivision Plat was prepared by Thompson & Fleming Land Surveyors. The metes and bounds description of the conservation area was also prepared by Thompson& Fleming Land Surveyors and included in Attachment 4. 2.4 Rules for Public Use The open space will remain in private ownership until a time the City of Saratoga Springs takes responsibility for maintenance of the lands, trail and associated features such as the parking area. When public access is allowed, the following rules will be in place and posted at the trailhead parking area. Signage will acknowledge the City of Saratoga Springs as the land manager and will provide contact information for emergency response agencies. 1. General Use—Public access is for quiet recreation, education, and enjoyment of the natural, scenic outdoor environment. Its natural resources are protected, and these rules will be enforced. Observation of animals, plants, and other natural features is encouraged, but please stay on the trails. Treat this area and its resources with respect. Do not disturb wildlife and do not collect, pick or destroy plants or flowers. 2. Permissible Activities—Permissible activities in this area are observation of its natural features, walking, hiking, bicycling, cross-country skiing and snowshoeing, but ONLY on the trails. No other activities beyond those stated here are allowed. 3. Hours Open to Public— This area is open to all members of the public, without discrimination, between dawn and dusk. The trail is closed after dark. 4. Parking—Members of the public who want to use the trails should park only in at the designated parking area at the trailhead. Do not park on Kaydeross Avenue East when accessing this area. 5. Dogs—All dogs in this area must be kept on a leash and under leash control at all times. It is City law that you clean up after your pets. Please obey that law and carry out animal waste for proper disposal. 6. Litter and Trash—No litter or trash of any kind should be left in the area. The area is carry in/carry out. 7. Camping and Fires—Overnight camping and fires are prohibited. 8. Motorized Vehicles and Equipment—No motorized vehicles of any kind are allowed. This includes automobiles, trucks, all-terrain vehicles (ATVs), snowmobiles, golf carts, motor scooters, motorcycles, motorized bicycles, Segways, and trail bikes. Motorized equipment such as trail grooming equipment, chain saws and leaf blowers are also prohibited, except as 8 approved by the City of Saratoga Springs. Emergency vehicles and battery-powered wheelchairs operated by the disabled are exempted from this prohibition. 9. Hunting and Trapping—Hunting and trapping are prohibited. 10. Discharge of Firearms —Target shooting and discharge of all types of firearms, such as pistols, rifles, shotguns, pellet guns and use of slingshots, bows and arrows or other weapons are prohibited. 9 SECTION 3.0 OPEN SPACE OBJECTIVES 3.1 Protection One of the primary objectives for the open space at Kaydeross Avenue East is the long-term protection of open space. This objective will be achieved via the establishment of deed restrictions which will run with the lands. Establishment of the deed restrictions will provide long-term protection to the forested upland and Class 1 wetlands regardless of any future changes that may occur in wetland protection regulations. A second level of protection is created with the establishment of a conservation easement which will also cover the open space lands and be held by the City of Saratoga Springs. No vegetation, other than diseased or dead trees posing a risk to human health and safety, shall be removed from any portion of conservation area, and only then can the diseased or dead trees be removed with the prior written consent of the holder of the conservation easement. No trees may be"topped." 3.2 Educational Uses At the time of the preparation of this Management Plan, educational uses were envisioned as secondary objective. Requests for educational uses are encouraged and will be reviewed for approval by the City of Saratoga Springs once public access is allowed. A cataloging of wildlife species observed on the site is an opportunity that exists. This could be accomplished by setting up a recording station at the trailhead similar to a trailhead sign in/sign out log. A small protected box with forms for filling in observations on wildlife sightings could be provided, and the data collected could be compiled with updated species lists posted on a regular basis. 3.3 Scientific Uses At the time of the preparation of this Management Plan, scientific uses were not envisioned as a priority objective. Requests for scientific uses are encouraged and will be reviewed for approval by the City of Saratoga Springs once public access is allowed. 3.4 Restoration/Special Management Considerations No need for any restorative work has been identified. However, if such actions are identified through ongoing use, approval will be sought from the City of Saratoga Springs to undertake such work. The City will establish guidelines for making such determinations. The objective is to allow lands to perpetuate in a natural, non-managed condition. In the future, should habitat or species maintenance be given consideration, particularly maintenance to discourage non-native and/or invasive species, a plan will be developed and require approval from the holder of the conservation easement and any necessary regulatory agencies. 10 SECTION 4.0 IMPLEMENTATION OF OBJECTIVES 4.1 Protection Measures Required When Public Access is Allowed 4.1.1 Boundary Identification and Information Signs Signage identifying the area as protected open space will be erected along the tree line at areas designated by the City of Saratoga Springs Planning Board. Informational signage regarding the rules for public use as listed in Section 2.4 of this Management Plan will be posted at the trailhead and also near where the trail connects with Kaydeross Avenue East. 4.1.2 Entrance Signs In addition to the rule's signage, an entrance sign will be erected at the trailhead. Entrance signs will include the identity of the trail, a schematic map of the trail and the trail route and possible future connections to surrounding areas. The City of Saratoga Springs will review all signs prior to their placement. 4.1.3 Surveillance No surveillance is proposed. The Saratoga Springs Police will be called in if necessary. 4.1.4 Vehicle Control Large rocks, bollards, gates or other similar devices to exclude non-emergency vehicles will restrict entrances to the trail. 4.1.5 Visitor Control No specific visitor controls except signage are proposed. 4.2 Passive Recreational Use with Public Access 4.2.1 Trails See section 1.0 of this report along with Figure 5 for a description of the proposed trails. The trails shall be constructed in accordance with the approved subdivision plans. The trails will be inspected on a regular basis (annually at a minimum) and maintained in good working order by the City of Saratoga Springs. 4.2.2 Interpretive Signs In addition to the signage discussed in 4.1.1 and 4.1.2 there can be limited interpretive signage placed along the trail, such as a sign erected in the area of the significant tree and/or describing the functions and benefits of the wetlands. Tree, plant and animal identification signs, including common and scientific names may be placed in proximity to the trail. These signs must be approved by the City of Saratoga Springs prior to placement. 11 4.2.3 Monitoring of Use No formal monitoring is proposed. The holder of the City of Saratoga Springs will inspect the property at least once a year in order to monitor compliance with the terms of the conservation easement. 4.2.4 Parking Parking spaces are provided at the trailhead. 4.2.5 Structures With the exception of possible future boardwalk crossings of wetland Q-11, trailhead and interpretive signage, no permanent or temporary structures may be erected or maintained within the area of the conservation easement. 4.3 Special Management Consideration 4.3.1 Restoration or Improvement No planned restoration or improvements are required in the conservation area. Should any restoration or improvement work be envisioned in the future, such work plans would require the review and approval of the City of Saratoga Springs and any appropriate regulatory agencies prior to implementation. 4.3.2 Management of Habitats or Species The objective for the conservation area is to allow lands to perpetuate in a natural, non-managed condition.
