Granting the variance will not create a detriment to nearby properties or an undesirable change in the neighborhood character for the following reasons: The garage was designed by a qualified architect and constructed with a building permit.The structure will not be outwardly changed at all.The closest neighbor is more than 20 feet away from the garage.There will be no impact on traffic,since we live on a corner lot. No more than one car which will be parked inside the garage.Our lot has adequate space with over 14,000 s.t. There are two parking spaces on a paved driveway in front of the garage,or in the garage. The requested variance is not substantial for the following reasons: The lot is 14,453 sq.ft. The house has been in use since 1963 and the detached garage has been in use since 2005.There have been no complaints by any neighbors.The average lot width is 130 feet. 125'rear and 136 front. 4. The requested variance will not have an adverse physical or environmental effect on the neighborhood or district for the following reasons: There is city water and sewer.We expect there will be one or two persons living in the garage apartment. 5. Whether the alleged difficulty was self-created(although this does not necessarily preclude the granting of an area variance).Explain whether the alleged difficulty was or was not self-created: The garage was built with the possibility of using the second floor for livable space.There is approximately 400 s.f.of living area. Adequate windows,dormers and stairway are in place. For 16 years the space was used for storage. O'Connor,Mary Lynn Barney,Trustee 77 Crescent Ave., Saratoga Springs, NY 12866 Dear Ms. Tucker and Members of the Zoning Board: I have enclosed the application for an Area Variance. The application outlines my desire to utilize approximately 400 s.f. in the upper level of our two car detached garage. We have drawn up plans for living space above the garage. The garage was built in 2005 by a certified contractor, using an architect's plans, and inspected and approved by the building dept. of the city of Saratoga Springs. Until now,the garage was used as such, and the second floor was used for storage by family members and ourselves. Prior to discussing our plans with the Planning Department,we searched our neighborhoods for similar homes with studio apartments above their garages. Without much effort, we were able to quickly find many matches. For example, here are a few: 134 Crescent Street 141 Jackson Street 143 Jackson Street 10 Madison Street While we realize that because other properties have the studio apartments above their detached garages, it does not necessarily mean that we will be allowed to do the same. It is our desire to bring to you our plans and photos for discussion, and hopefully you will grant us the necessary approvals to begin working on our project as soon as possible.
