NOTICE OF DECISION
In the matter of the application - #20 I 80203/ I 8.0 I 7
ANW Holdings, Inc.
32 Hyde and 9 Birch Streets
Saratoga Springs, NY I 2866
Involving the premises with tax parcel no. I 65.73-2-4 I . I I in the City of Saratoga Springs, on an application for a
modification to a previously approved subdivision in the Urban Residential (UR-2) District; specifically,
modification of a condition of approval, "Mature Silver Maple tree located along the southeast property boundary
shall be preserved and protected during construction with detail to be provided on final plans".
The Planning Board issues the following decisions on November 5, 2020 (passed 7-0-in favor: Torpey, Horton,
Fabozzi, Boivin, Bonitatibus, Mayo, Doty):
Moved to reaffirm the Negative SEQRA Declaration from the original subdivision approval.
Moved to approve the subdivision modification as detailed in correspondence received October 2, 2020 and as
per landscaping plans for I 3 Birch Street and 36 Hyde Street submitted October 29, 2020 per the requirements
set forth in the City of Saratoga Springs Subdivision Regulations with the following conditions:
• The landscaping plans for I 3 Birch St. and 36 Hyde St. shall be certified by a Landscape Architect
as to the appropriateness of the specific locations of the I 4 total on-site trees (9 hornbeams and
5 dogwoods).
• The applicant shall purchase, deliver to the site, and install 4 large canopy trees (min. I 0" — I 2"
DBH) in the City ROW or on City property within the Westside neighborhood.
• The applicant shall provide specific species and locations for the above 4 large canopy trees for
review and approval via administrative action by the Chair in consultation with City staff.
• All conditions of the original subdivision approval shall remain in effect.
The applicant is required to complete the following as per the City of Saratoga Springs Subdivision Regulations:
• Deliver a letter of credit or cash escrow (or revise the existing LOC) in the amount approved by the City
Engineer as a performance guarantee to the City for required on- and off-site improvements — to include
the above improvements. This must occur prior to signature by the Planning Board Chair of the revised
subdivision plat.
• Submit two (2) mylar and two (2) paper copies of the revised subdivision plat for signature by the
Planning Board Chair.
