Dear Ms. Barden:
Thank you for your October 1, 2020 lead agency communication for the above project,
pursuant to the State Environmental Quality Review Act (SEQR).
DEC Position: Based on the information provided, DEC concurs with your
recommendation that the City of Saratoga Springs Planning Board serve
as SEQR Lead Agency for this project.
New York State regulated Freshwater Wetland S-16 and adjacent area is in the project area.
Any disturbance within the wetland and the 100-foot adjacent area will require an Article 24 -
Freshwater Wetlands Permit.
In accordance with the DEC Freshwater Wetlands Permit Requirements Regulations, all
efforts must be made to avoid disturbing the wetland and its 100-foot-wide adjacent area.
The regulated area should remain undisturbed unless there are no feasible alternatives. If
the wetland and adjacent area cannot be avoided, the project sponsor will need to justify the
disturbance, discuss alternatives, and minimize impacts as part of the Freshwater Wetlands
permit application.
To protect the wetland resource, all limits of disturbance should be more than 100 feet from
the wetland (with a continuous line of silt fencing along the limits of disturbance). Sediment
barriers are to be installed before construction begins and be maintained until work is
complete and disturbed areas are vegetated.

Disturbance of more than one acre of total land will require a SPDES General Permit for
Storm Water Discharges from Construction Activities (GP-0-15-002). This general permit
requires development of a Storm Water Pollution Prevention Plan, and submission of a
Notice of Intent to DEC. The General Permit and related information are available on the
DEC website: http://www.dec.ny.gov/chemical/43133.html.
Please contact our Division of Water at (518) 623-1232 if you have questions regarding the
stormwater requirements.
GIS review indicates that the project site is located within an archaeologically sensitive
area. It is suggested that recommendations be sought from NYS OPRHP regarding the
potential impacts on historic and archeological resources from the development of this
area. Additional information can be found on NYS OPRHP's website at
http://nysparks.com/shpo/online-tools/ or by calling (518) 237-8643. Potential impacts to
these resources must be considered in the State Environmental Quality Review (SEQR)
documentation. For example, previous disturbance should be described to indicate whether
future project components will have the potential to further affect archeological resources.

Name of Action: Excelsior Park Project, Excelsior Avenue at Ormondy, Saratoga Springs
Dear Susan Barden:
With this letter, New York State Homes &Community Renewal (HCR), through the Housing Trust Fund Corporation
(HTFC) and the Housing Finance Agency (HFA), consents to the City of Saratoga Spring's assumption of Lead Agency
status in conducting a coordinated State Environmental Quality Review for the proposed project.
In the event that HCR makes a future funding award, it would require submission of the following items by the project
sponsor:
• The project sponsor would be required to submit a copy of a final impact determination letter from the NYS Office of
Parks, Recreation and Historic Preservation.
• The project sponsor would be required to submit copies of a SPDES General Stormwater Permit if the project would
disturb one or more acres.
• The project sponsor would be required to submit a copy of a Phase I Environmental Assessment report which must
meet, at a minimum, the American Society for Testing and Materials standard for site assessment and include a
Vapor Encroachment Screen. Any Recognized Environmental Conditions or environmental concerns would need to
be resolved per HCR RFP requirements.
• The project sponsor would be required to submit a copy of all floodplain and wetland permits.
• The project sponsor would be required to submit evidence to support compliance with the NYS Smart Growth Public
Infrastructure Policy Act.
• The project sponsor would be required to submit a site suitability analysis per HCR requirements.
o Note that this includes an impact analysis of flood hazards presented by upstream dams. In this case the flood
mapping included in the Loughberry Dam studies would need to be consulted. We have received notice that the
studies on file may not be entirely accurate and further review by NYSDEC may be necessary.
