IN THE MATTER OF THE APPEAL OF

from the Building Inspector's determination involving a parcel at 99 Fifth Avenue, in the City of Saratoga
Springs, New York, being Tax Parcel 166.14-I-21 on the assessment map of said City.
The applicant having applied for an area variance under the Zoning Ordinance of said City to permit the
construction of a two-story residence and pool in the UR-I District and public notice having been duly given of
a hearing on said application held on October 19 and November 9, 2020.
In consideration of the balance between benefit to the applicant with detriment to the health, safety and welfare
of the community, I move that the following area variance for the following amount of relief:

As per the submitted plans or lesser dimensions, be approved for the following reasons:
I. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the
applicant. The applicant wants to construct a single-family home on a vacant corner lot of Fifth Avenue
and Schuyler Drive. In order to construct the home with an attached two-car garage, an additional
4.3% coverage over the 20% allowable has been designed to accommodate the additional storage
necessary for pool and yard equipment.
2. The applicant has demonstrated that granting this variance will not create an undesirable change in the
neighborhood character or detriment to nearby properties. The applicant has designed the home to fit
in with the facades on the north side of Fifth Avenue, including a one-story front porch as the entry to
the home. The applicant also moved the garage further away to a distance of 26.I' from the first
presentation of 22.5' to create less impact on the Schuyler Drive site lines. Due to the fact that this is a
corner lot and has two fronts,the distance on the front setback variance is a reasonable request.
3. The relief requested for principal coverage may be considered substantial at 21.5%, while the Board
considers the front setback not to be substantial. The applicant provided lot coverage information for
homes in the neighborhood on both the south and north side of Fifth Avenue with maximum principal
coverage at or exceeding the requested amount of 24.3%. Due to the fact that this is a corner lot and
has two fronts, the distance on the front setback variance is a reasonable request. Further, the home,
pool and all mechanicals will total lot coverage of 27.9%, less than the permitted 28% Total Lot
Coverage.
4. The applicant has demonstrated this variance will not have an adverse physical or environmental effect
on the neighborhood. Permeability will meet the district requirement.
5. The difficulty may be considered self-created. However,this is not necessarily fatal to the applicant.
Conditions:
No further accessory structures.

This variance shall expire 18 months following the filing date of such decision unless the necessary building
permit has been issued and actual construction begun as per 240-8.5.1.
