Saratoga Springs,NY 12866 RE: Franklin Square Condominiums, 71-81 Railroad Place, Saratoga Springs,NY To Whom It May Concern, It has come to the attention of the Building Department that changes have been made to your property at 71- 81 Railroad Place in the City of Saratoga Springs without the proper approvals from the Planning Board and - in violation of NYS Building Code. The accessible parking space has been eliminated and the rear two-spot area has been changed to three spots.This is a violation of Article 7.2.11 the City of Saratoga Springs Zoning Ordinance. Failure to either comply with your approved site plan or obtain the appropriate amendment to that approval by 4/18/16 will result in legal action in the form of an Appearance Ticket. At that time you will be compelled to appear before the City Court judge to show cause as to why you have not complied. At that time the City will also seek appropriate fines, up to$250 per day, for each violation. I am enclosing a copy for your reference. In the Notice of Violation, Mr. Shaw cites Article 7.2.11 of the Zoning Ordinance as the article which has been violated. Is it possible in 2016 for a building to not have one designated handicapped space available? The 3 other large buildings on Railroad Place all have a designated handicapped parking space available to access their buildings, but our building does not have one single handicapped parking space. Our Association Board and our Management Company both refuse to take responsibility concerning this matter, even after acknowledgement of being in violation. I was in your office in November and spoke to you personally about this violation. You were able to look on the planning map and find that our building was approved with a handicapped parking space and you can see this space identified on the map. We looked at it together in your office. There is still no such parking space in the back of the building. In fact, the Board President (Deb Poissedente) has informed me that the Condo Association actually "sold" the handicapped parking space to a private individual. Therefore, the building has NO HANDICAPPED SPACE for the building. This has been the case for years. It just so happens that now we have people who wish to purchase or rent in the building who cannot since there is no handicapped parking available. Could you please look into this further? The Board has informed me that they have decided as a Board "not to bother with the absence of a Handicapped Parking Space at this time." I believe that this may be a Federal violation as well. I understood that the city was going to contact them and let them know that they are in violation. Has the city informed them and followed up on this? Has your office been able to contact anyone? I have attached the contact information for you. Please advise me what I should do. I have been an owner of a commercial unit there for more than 16 years and I have had an interested buyer as well as renter who have decided not to buy/rent there because we have no handicapped parking available. So far the following issues have come up: 1 - Although the plans don't address this at all, the application states that the slabs (landings) are also being replaced. The architect needs to include certified drawings for this renovation as well. There may be code concerns if the existing structure has to carry additional dead loads. 2 - One set of all drawings, bearing the seal and signature of the licensed professional, will be required for the permit. 3 - What is intended for the "temporary" stairs? How long will they remain in place? What is the construction of them - tread, riser, handrails etc. information is needed? 4 - will the handrails and guards also be removed from the site, to be refabricated in the shop, or will they remain in place? How about the stringers - do they remain in place, or get removed from site? 5 - Will center handrails be included on the wide stairs to meet new code concerns?
