DANIELS ' SECRETARY OF STATE -In the Matter of the Petition of DECISION Olsen Associates For a Variance to the New York State PETITION NO. 2001-0401 Uniform Fire Prevention and Building Code Upon the application of Olsen Associates filed pursuant to 19 NYCRR 450 on April 30, 2001 and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to the construction of a Cl (business) occupancy, one story in height, of type 5b(wood • frame) construction, approximately 192 square feet in cumulative gross floor area, at 267 Union Avenue, City of Saratoga Springs, Saratoga County, State of New York. The petitioner is seeking relief from: 9 NYCRR 900.2(d)(6), which requires that plumbing fixtures for employees be located within the same building when the building exceeds 100 square feet in area. [The petitioner proposes the alternative of installing plumbing fixtures in a neighboring building that is located 140 feet away from the proposed Cl occupancy.] FINDINGS OF FACT 1. The proposed building is a small building that is 12 feet by 16 feet in outside dimensions. It is intended to be used as an office by one horse trainer during the racing season. There is also under construction another building called the Oklahoma Pavilion. 2. The Oklahoma Pavilion is located 140 feet from the subject building and consists of two restrooms, one for men and one for women. 3. The building contains a total of 4 water closets, 2 urinals, 2 showers and 5 lavatories. These facilities will be available to the occupant of the subject building. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would be unnecessary in light of the alternative which will achieve the intended objective.
