This letter is in_response-�to, your_receut_irngtliryasto`.._._
the progress that is being made for the construction of
a second exit structure at 42 Circular St. Saratoga Spr, NY.
After discussions with my father who owns the building,
and is overseas till July we arrived at the fact that in
order to make a sound decision on the various alternatives
available, it would be necessary to consult with an architect.
We have contraced the services of Mr. David L Degiorgis of
Pittsfield , Mass (a personal friend) to come up with three
alternatives that would achieve the following goals;
1) To reduce the number of apartments (4 to 3) as we
had discussed.
2) To design a steel structure to meet the codes as
• you outlined them, that would provide second exits
from both the second and third floor.
3) To design the structure so that it be hidden from
the exposed sides and front of the building.
4) Finally to provide us with drawings as to the changes
that will be necessary to consolidate the two apts.
on the second floor.
Based on the discussions I have had with the architect, it
has become obvious that North-East corner of the building
is the most appropriate spot for the construction of the
steel structure mainly because it is the only spot in which
one structure will be able to• serve both floors.

To this date I have recieved two estimates_for:Lthat_ work
that is to be completed. Those, copies are available at
your request. In addition this week I have one more set of
plans that has been drawn up by a local contracting co. ,
and I should recieve their estimate in the next week.
My father and I are both eager to begin the work that is
necessary to meet state code requirements for exits.
following the review of this last estimate I will be
selecting the two that make the most sense to us, and I
would like to review them with you. I expect to begin
construction within the' next 3-4 weeks. During that time
if I can answer any questions please feel free to call

Dear Mr. & Mrs. Okby:
As you may recall, we inspected your apartment building in late
December 1984, based upon a tenant concern that there was no second
exit from her upper floor apartment. At that time, we viewed the whole
building and it was determined that there definitely were exit defi-
ciencies, not only from the third floor but also from the second floor.
You were advised at that time that immediate attention would have to be
giiren to the need for compliance with building code and fire safety
regulations dealing with required exits for apartment buildings, and I
advised you to contact professionals who could design and determine the
best possible solution to your exit problems.
Other than hearing from you in February that you were going to
discuss this situation with your father, I have no indication that this
matter is even close to being resolved. There will be no choice but to
condemn for occupancy all but the first floor of this apartment building
if you do not begin to bring your building into compliance with code.

APPLICATION IS HEREBY MADE to the Building Department for the issuance of a
Building Permit pursuant to the State Building Construction Codes for the
construction of buildings, additions or alterations,, or for removal or demolition,
as herein described. The applicant or owner agrees to comply with all applicable
laws , ordinances, regulations and all conditions expressed on this application
which are part of these requirements , and also will allow all inspectors to enter
the premises for the required inspections. The following regulations shall apply:
A. Application must be filled in completely and submitted to Building Department.
B. Application must be accompanied by:
1. Plot plan showing lot dimensions ; buildings on the lot and their distances
, to one another and to the lot lines; and a detailed description of the
layout of the property.
2. Complete set of plans showing proposedconstruction and a complete set of
specifications for this proposal.
3. Appropriate permit fee.
-.,C. Work covered by this application shall not commence prior to permit issuance.
D. Occupancy of a building or premises to which this application applies shall not
occur prior to the issuance of a Certificate of Occupancy by this Department.
E. Any deviation from the approved plans must be authorized by the approval of
revised plans subject_ to the same procedure established for the examination of
the original plans:
F. Building Department shall be notified according to the required schedule of
inspections , which shall include but not be limited to`:
1 . Foundation footings before pouring concrete.
2. Foundation before backfill.
3. Secure surveyor' s location of foundation and submit to Building Department.
4. Plumbing, heating, framing and electrical before closing in of frame work.
5. Prior to any occupancy, final inspection for Certificate of Occupancy.
G. All electrical work needs an inspection by and a certificate of compliance from
the New York Board of Fire Underwriters.
H. This building permit is effective for one year from the date of issuance.
