Dear Mr. &Mrs. Gersin,
As you are aware,the shed on your property is located within a no-cut buffer as established by the Planning
Board on the Interlaken Zone "C"PUD site plan. As per Note 14 of the site plan,no accessory structures
shall be located within the no-cut buffer.
The optimal,most expedient, and most realistic path of resolution continues to be: move the shed to a
compliant location outside of the no-cut buffer and meeting the required setbacks. This is in keeping with
the required remedy from the Notice of Violation/Order to Remedy dated September 16,2019.
It is my understanding that you have sought an alternative remedy by requesting relief from the Zoning
Board of Appeals. After further research into the deed covenants and restrictions,and consultation with
land use board counsel, it was confirmed that the Zoning Board of Appeals does not have the authority grant
the relief required,which amounts to a modification of an approved site plan. The City will be issuing you a
reimbursement for the cost of your application to the ZBA. As an alternative method to remedy this
violation,you may pursue a modification to the approved site plan through the City of Saratoga Springs
Planning Board.
As established by the approved Site Plan,the Summer Wind HOA is responsible for carrying out the
maintenanceand enforcement of the no-cut buffer. The Planning Board will not be able to consider a site
plan modification application without the written support/approval of the HOA. The HOA review must be
based on an accurate representation of the existing shed location on the lot.
By purposes of this letter, I am notifying you that remedial action is required immediately. You are required
to move the shed in question or file an acceptable application to the Planning Board by November 2,2020.
Failure to remedy as instructed by November 2nd will result in an Appearance Ticket,where the City will
seek an Order to Show Cause why the violation has not been remedied. The City will also seek fines as
detailed in the Notice of Violation.
