That the variance, if granted, will not alter the essential character of the neighborhood. Changes that will alter the character of a neighborhood or district would be at odds with the purpose of the Zoning Ordinance. The requested var-iance will not alter the character of the neighborhoad for the following reasons: 4. That the alleged hardship has not been self-created.Aapplicant(whether the property owner or one acting on behalf of the property owner)cannot claim"unnecessary hardship" if that hardship was created by the applicant,or if the applicant acquired the property I<nowing(or was in a position to know)the conditions for which the applicant is seal<ing relief. The hardship has not been self-created for the following reasons: Revised 01/2019 ZON(NG BOARD OFAPPEALSAPPLlr11 TlON FORM PAGE 6 AREAVARIANCE—PLEASEANSWERTHE FOLLOWING(add additional information as necessary): 6.4.5 WALLS AND FENCES The applicant requests relief fiom the following Zonig Ordinance article(s) A. Whether granting the variance will produce an undesirable cfiange in the character of the neighborhood or a detriment to nearby properties. Granting the variance wili not create a detriment to nearby properties or an undesirable change in the neighborhood character for the following reasons: There is no change in the character of the neighborhood with this request. The court is tucked away and surrounded by trees. This court is in the middle of orropLty(i.e. not on aro ey line nor near aroLty line)and can not be seen or barely be seen b our neighbors(in winter),due to tree coverage on all sides(it is also not seen by the road). Revised O1/2019 ZONlNG BOARD OFAPPEALSAPPLICATJON FORM PAGE 7 3. Whetner the variance is substantial. The requested variance is not substantial for the following reasons: No,this variance is not substantiai. It is only a 4'foot variance in the height of the fence(fence coverage is a rectangle 116 feet x 70 feet). This is the standard look for all tennis and basketball courts and we are in the rurai residential neighborhood with neighbors very far away(we have a 2.3 acre parcei). 4. Whether the variance will have adverse physical or environmental effects on neighbor•hood or district. The requested variance will not have an adverse physical or environmental effect on the neighborhood or district for the following reasons: The variance will not have an adverse physical or environmental effect on the neighborhood or district because no one can see it thrugh the woods and thick tree coverage on all sides. 5. Whether the alleged difculty was self-created(although this does not necessar-ily preclude the granting of an area variance). Explain whether the alieged difficulty was or was not seif-created: It was not self-created.Tennis courts and basketball courts are allowed in Saratoga Springs on residential properties. They look nice and bring value to the properties on which they are built.
