THIS AGREEMENT is made , 202fl between Caro�ine
Steuer, aka Karrie Steuer,residing at 20 Geyser Road, Sarataga Springs,New York 12866
("Steuer")and Deana Signor,residing at 14 Geyser Road, Saratoga Springs,New�ork 12866
("Signor"), collectively the "Parties".
WITNESSETH:
WHEREAS, Steuer is the fee owner of certain lands lacated in the City of Saratoga
Springs, County af Sarataga, known as 20 Geyser Road, Saratoga Springs,New York, by virtue �
of that certain Deed fram Jahn F. Hendrickson, Executor af the Estate of Marie Louise Whitney
Hendrickson to Steuer dated , 2020 and to be recorded in the Saratoga County Clerk's
Office immediately prior to the recording of this Agreement; and
WHEREAS, Signor is the fee owner of certain lands lacated in the City of Saratoga
Springs, County of Saratoga, known as 14 Geyser Road, Saratoga Springs,New York by virtue
of that certain Deed from Jahn F. Hendrickson, Executor of the Estate of Marie Louise Whitney
Hendrickson ta Signor dated , 2020 and to be recarded in the Saratoga County Clerk's
Office immediately prior to the recording of this Agreement; and
WHEREAS, 14 Geyser Raad shazes a partion of the driveway leading to 20 Geyser
Road, which portion is described on the attached Schedule A(the"Shared Driveway Easement
Area"), as a shared camman driveway for ingress and egress to their respective properties as
shown on the map entitled Survey of Lands of Marie Louise Whitney dated July 27,2020 and
filed in the Sazatoga County Cierk's Office Qn , 2Q20 as Map no. (the"Map");
and
WHEREAS,the Parties are desirous of creating a permanent easement for the purpose of
permitting and enabling present and future owners of 14 Geyser Road, their heirs, successors and
assigns ingress and egress over the Shared Driveway Easement Area, and to set forth the mutual
rights and obligations for the use and maintenance af the Shared Driveway Easement Area; and

WHEREAS, utilities servicing and to service 20 Geyser Road pass under and through a
portion of 14 Geyser Road runriing parallel and contingent to the Shared Driveway Easement
Area, and Signor desires to pravide a permanent easement to Steuer in favor of 20 Geyser Road
for present and future utilities through the Utility Easement Area as described on the attached
Schedule B,
NOW THEREFORE, in consideration of the premises and of the mutual grants,
covenants and agreements herein set farth, the Parties hereto, for themselves,their heirs,
successors and assigns agree as follows:
SHARED DRIVEWAY EASEMENT Al'�D MAII'�TENANCE AGREEMENT
FIRST: Steuer hereby grants to Signor, aver the Shared Driveway Easement Area, as
described on the attached Schedule A, a permanent easement that runs with the land,to be used
with Steuer, for vehicular and pedestrian ingress and egress in, over and upon the Shared
Driveway Easement Area, with the free and unrestricted right ta use the Easement Area at ail
times hereafter for the purposes herein stated and generally for such other purposes as may be
reasanable consistent with the use of the same as a private common driveway serving residential
dwellings, inciuding the constructian thereof.
SECOND: All reasonable and customary casts and expenses incurred in maintaining and
repairing the Shared Driveway Easement Area and any other costs, expenses or liabilities
incurred in connection with the Easement Area shail be shared equally, with each lot awner
paying one-haif(1/2) of said costs for the hared Driveway Easement Area. However, in the
event damage is caused to the driveway as a resutt of construction vehicles or heavy equipment
or vehicles,the party who authorized such work shall repair such damage.
THIRD: That any persons from time to tirne occupying 14 Geyser Road or 20 Geyser
Raad, or their guests or invitees having occasion ta use any pvrtian of the driveway shall at no
time, whether during the day or night,park vehicles upon the Shared Driveway Easement Area
ar otherwise obstruct the same in such a way as to prevent or interfere with the free and

unrestricted right to use said Shared Driveway Easement Area for ingress ar egress as
hereinbefore set forth,
UTILITY EASEMENT IN FAVOR UF 20 GEYSER ROAD
FOURTH: Signor hereby grants and releases to Steuer, over the Utility Easement Area
as described on Schedule B, a permanent non-exclusive easement over, under and through the
Utility Easement Area for the following purposes: {a) the installation,operation, maintenance,
repair,upgrading and replacement of underground utility lines, including without limitatian,
electricity, telephone, cable, water and sewer(the "Utility Lines"),as currently located or
reasonably lacated or relacated in the future.
FIFTH: Steuer agrees to restore the land within the Utility Easement Area after any
work by ar an behaif of Steuer,to the prior existing line and grade, and to restore the vegetative
cover on the land within the Utility Easement Area and any other affected area.
SIXTH: the provisions of this Agreement shall be for the benefit of and shall run with the
land of the Parties, specifically 14 Geyser Rd. and 20 Geyser Rd.,and shall be hinding upon the
Parties and their respective heirs, representatives, successors, and assigns.

BOUNDARY LINE ADJUSTMENTS
THIS BOUNDARY LINE ADNSTMENTS (the "Adjustments") is made as of Septernber
, 2020 by John F. Hendrickson, Executor of the Estate of Marie Louise Whitney Hendrickson
(the"Estate"),residing at Cady Hill,40 Geyser Road, Saratoga Springs,New York 12866.
WITNESSETH :
WHEREAS,Marie Louise Whitney owned several cantiguous parcels of real property in the
City of Saratoga Springs, Sarataga County,New York as itemized an the attached EXHIBIT 1;and
WHEREAS, the Last Will and Testament af Marie Louise Whitney Hendrickson, which
was admitted to Probate in the Saratoga County Surrogate's Court an February 24, 2020, devises
the parcels at 14 Geyser Road and 20 Geyser Road to individuals;and
WHEREAS, a portion of the house and the shed belonging to the 10 Geyser Raad parcel,
encroach onto the 14 Geyser Road parcel; and
WHEREAS, the back deck of the house belonging ta the 24 Geyser Road parcel
encroaches onta a vacant sliver of land contiguous to the 20 Geyser Road parcei; and
WHEREAS, the Estate desires to resolve these encroachments and ather issues prior to
deeding the parcels to the devisees, by adjusting the baundary lines as they currently e�st, and by
annexing the unirnproved sliver of land parcel to the 20 Geyser Raad parcei, all as described on
EXHIBIT 1; and
WHEREAS, the map attached as Exhibit II is a reduced copy of the original rnap tit(ed
Survey of Lands of Marie Louise Whitney Hendrickson dated July 27, aaaa, which was approved
by the {Chairman of the) Planning Board of the City of Sarataga Springs, New York on

2020, and was filed an , 2020 with the Sarataga Caunty Clerk as Map
no. (the"Map").
NC7W,THEREFORE,the Estate hereby makes the follawing boundary line adjustments:
1. l.4 Gevser Road. The baundary lines between the 14 Geyser Road and 14 Geyser
Road parcels are adjusted as shown on the Map to remove the encroachments. This
adjustrnent increases the acreage of the 10 C'.reyser Road Parcei from 14,038 square
feet to 17,914 square feet(.411 Acres approximately). The resulting new metes and
bounds description of 10 Geyser Road is set farth on the attached SCHEDULE A.
2. 20 Gevser Road. The boundary lines between the 20 Geyser Raad parcel and the
14 Geyser Road parcel are adjusted; and the contiguous sliver of land is annexed
ta the 20 Geyser Road parcel to remove the encroachment, bath of which result in
an increase in the acreage af the 20 Geyser Road parcel from 1.124 acres to 2.986
Acres. The resuiting new metes and bounds description of 2Q Geyser Road is set
forth on the attached SCHEDULE B.
3. 14 Gevser Road. The acreage of the 14 Geyser Road parcel prior ta the
adjustments was 4.187, and as a result af these adjustments, is 2.265 acres. The
resulting new metes and bounds description of 14 Geyser Road is set forth on the
attached SCHEDULE C.
The above boundary line adjustments are hereby effected, and this Agreement
sha11 run with the land and be binding upon and inure ta the benefit of the respective heirs,
representatives, successors and assigns of the Estate.
