In accordance with 6 NYCRR Part 617, the Planning Board classified this action as a Type I Action. And, acting as Lead Agency, issued a Negative SEQRA Declaration on June 20, 2019. And, in accordance with objectives, standards and guidelines contained in the City Zoning Ordinance, chapter 240, article 7.2 "Site Plan Review",the Planning Board issues the following decision on August 13, 2020 (passed 7-0 in favor: Torpey, Totino, Horton, Fabozzi, Bonitatibus, Mayo,Jenks): Due to the time sensitivity for submission for State-funding for this affordable housing project that will provide significant public benefit to the community the Board approves the site plan set dated May 8, 2020 with the following conditions: I. Review and approval by the Chair of any minor revisions to the site plan set upon final review by the City's designated engineer(D.E.) and the departments of Public Works and Public Safety(DPW, DPS). If final review reveals any material changes to the plans then the applicant will return for Board review. 2. A permanent physical barrier and signage "emergency vehicle access only" or similar language across the access road from Tait Lane shall be to the satisfaction of DPS. 3. Final plans shall be provided to the satisfaction of the City's D.E., DPW and DPS. 4. The Board finds a proper case exists for requiring a park or other recreational facility and accepts a fee in lieu of dedication of recreational lands for the 202 residential units. 5. Sketch plan (L-2 Layout Plan) submitted Aug. 4 identifying compliance with the minimum frontage build- out at 56%for Building 3 along Tait Lane will be incorporated into the final plan set. 6. Submitted access easement language to be reviewed and approved by the City Attorney. 7. The Chair will submit on behalf of the Board a formal request to the Commissioner of DPS to petition NYS DOT for a reduction in the speed limit from 45 mph to 30 mph along NYS Route 9 (Church St.) from West Ave. to Locust Grove and also consideration for bike/pedestrian accommodations in this area. The applicant shall provide full support and endorsement of this petition to enhance the overall safety at the intersection of Allen Drive and Route 9N. Page I of 2 8. Applicant shall continue to partner with CDTA per letter of commitment dated August 5, 2020, stating "CDTA will continue to coordinate with the LA Group to determine and develop the best service or combination of services for the area as this project moves forward, as well as the potential for a Universal Access partnership". 9. Note applicant identified a minimum 30-year commitment to provide affordable housing units at 30% to 80%Albany Schenectady Troy Metropolitan Statistical Area Median Household Income (AMI). 10. Prospective renters to be provided information on how to participate in NYSERDA Solar-for-All program. The applicant is required to: I. Deliver a letter of credit or cash escrow in the amount approved by the City Engineer to the City per Article 7.2.15 of the City of Saratoga Springs Zoning Ordinance. This must occur prior to final signature by the Planning Board Chair. 2. Submit a fee in lieu of recreational lands of$2,000 for each new residential unit per Article 7.2.18 of the City of Saratoga Springs Zoning Ordinance. This must occur prior to final signature by the Planning Board Chair. 3. Submit one (I) mylar and two (2) paper copies of the final approved site plans for signature by the Planning Board Chair within eighteen (18) months of approval as per Article 7.2.12 of the Zoning Ordinance. Note: this approval shall expire within eighteen (18) months of the signature of final plans if the applicant has not started actual construction as per Article 7.2.14 of the Zoning Ordinance.
