I am presently under contract to purchase the above referenced
premises from Vincent Sarro. That the proposed transfer is contingent
upon obtaining the zoning variance requested herein, It is my intention
to use the premises for the operation of my small plumbing business which
is a sole proprietorship, I presently hold a plumbing license from the
City of Saratoga Springs. I have two employees other than myself. The
structure which is presently located on the premises is a two bay garage.
Picture of the aforesaid is attached hereto and made a part hereof as
Exhibit A. This structure was constructed pursuant to a building permit
granted to the owner of the premises Vincent Sarro. A site plan indicating
the location of the building on the premises is annexed hereto and made a
part hereof as Exhibit B, It is my intention to put an addition of ap-
proximately 15/to 20' on said building and to convert a portion of the
building from a garage to use as an office, A rendering of the proposed
alteration is annexed hereto and made a part hereof as Exhibit C.
The character of the neighborhood would not be disrupted or in any
way adversely affected by my business . , since the work is performed off.

APPLICATION IS HEREBY MADE to the Building Department for the issuance of a Building Permit pursuant
to the State Building Construction Codes for the construction of buildings, additions or alterations, or for re-
moval or demolition, as herein described. The applicant or owner agrees to comply with all applicable laws,
ordinances, regulations and all conditions expressed on this application which are part of these requirements,
and also will allow all inspectors to enter the
p premises for the required inspections. The following regulations
shall apply:
A. Application must be filled in completely and submitted to Building Department.
B. Application must be accompanied by:
1. Plot plan showing lot dimensions; buildings on the lot and their distances to one another and to the lot
lines; and a detailed description of the layout of the property.
2. Complete set of plans showing proposed construction and a complete set of specifications for this
proposal.
3. Appropriate permit fee. •
C. Work covered by this application shall not commence prior to permit issuance.
D. Occupancy of a building or premises to which this application applies shall not occur prior to the issuance
of a Certificate of Occupancy by this Department.
E. Any deviation from the approved plans must be authorized by the approval of revised plans subject to the
same procedure established for the examination of the original plans.
F. Building Department shall be notified according to the required schedule of inspections, which shall include
but not be limited to:
1. Foundation footings before pouring concrete.
2. Foundation before backfill.
3. Secure surveyor's location of foundation and submit to Building Department.
4. Plumbing, heating, framing and electrical before closing in of frame work.
5. Prior to any occupancy, final inspection for Certificate of Occupancy.
G. All electrical work needs an inspection by and a certificate of compliance from the New York Board of Fire
Underwriters.
H. This building permit is effective for one year from the date of issuance.

Dear Mr. Sarro :
On May 15, 1978 this office issued you a building I
permit for a residential-type two-car garage, having
dimensions 24'feet. by 24 feet.
In passing by the property today .I witnessed automobile j
repairs being conducted not only within the building
but also outside. At least four vehicles were parked
on the property and two or three people were busy
working on said vehicles.
Please be advised that your property is located in a
residential zone, and that this automobile repair
operation isnot permitted within such a zone, and
furthermore that it must cease immediately.
Any use other than as a residential-type garage 1
for which you applied and were granted a building
permit will need to be reviewed and approved by this
office and possibly by the Zoning Board and Planning
Board.

finding of fact : Area variance to construct a single family residence on
Marvin Alley, between Division Street and Cherry Street, as shown on submitted
plans, be denied.
The applicant has not demonstrated practical difficulty that would result in
significant economic injury if the area variance were not granted.
The granting of this variance will have an adverse impact on the essential
character of the neighborhood.as applicant is proposing a substandard size house
on a substandard size lot. The Board deems it both unsafe and unwise to permit
such development.

The site plan attached.to this memorandum proposes three separate projects
which are in turn interrelated. This memo attempts to summarize the three
projects in order to highlight the considerable amount of thought that has
gone into the projects and hopefully to indicate why the combined projects
will contribute to the development of the neighborhood and the City at large.
The reasons are as follows:
1. The lots in question are zoned Multiple Residential. (I note the
small lot on Marvin Alley may also be zoned R-4 because of the
grandfathering provision of the PUD ordinance.) The ordinance's
purpose for R-4 is to encourage the development of multiple family
housing adjacent to the central business district. This type of housing
will broaden the diversity of the City's affordable housing stock, but
also to strengthen the cities central core.
The area where these projects are located historically, have been
fragmented into a multiple of small underutilized lots. By combining
an assemblage of these parcels, a workable solution to achieve the goal
of multiple family housing for the neighborhood is achieved.
2. The neighborhood where the proposed projects are located is an
area of insecurities. The people who live in the Franklin Square area
are desperately trying to achieve a sense of security frout•wr at they
consider is an out slaught of industrial development. The hard won
balance between industrial, commercial and residential development
is teetering on the brink..
By investing significant sums into residential development along the
very boarder of the industrial PUD, this project will secure the
neighborhood into the zone originally envisioned by the zoning
ordnance and the PUD. The residential and retail nature of the
Franklin Square Area will be secured and the slow encroachment of
the industrial users will be provided for inside the boarders of the
PUD where they were intended to be.
•
3. Without question, one of the significant needs in Saratoga is for
affordable housing. The three projects as a totality, contribute by
providing, three distinct types of affordable housing.
First of all, the project on Cherry Street utilizes State Funds through
the New York State housing Trust Fund, to rehabilitate a building of
historic merit, into decent large family oriented apartments, at below
market rental rates, for people with below medium level incomes.
After completion by Franklin Square Associates, title will be turned
over to the Saratoga Springs Preservation Foundation to administer
the property for the benefit of low income people, in perpetuity. The
current living conditions in this building are deplorable.
The seven unit apartment building planned for Marvin Alley is made
possible by the newly rehabed structure buffering the industrial
development mentioned above and the ability to acquire the land
made possible by the apportionate of costs between the two projects.
Very few moderately priced multiple family units can be built
because of high land valve and the abolition of tax incentives
previously available. When units will be suitable for the elderly and
young persons not yet able to afford to buy their own homes. Because
of the location, the market will dictate moderately priced rental rates.
Nd government funding will be used for this building.
The small house which may be moved to another site along Marvin
Alley if feasible, will provide another affordable single family house
which is often lacking in Saratoga Springs. Again because of the
location, the market will dictate reasonably priced housing. It is also
hoped that if this structure can be reasonably moved, a small but
precious historic building will be resurrected from the dilapidated
shack currently visible. It is very important that this structure or one
like it help screen the industrial development from the historic
Franklin Square area.
4. Finally, Franklin Square Associates takes considerable pride in
seeing the Franklin Square area developed from its former status of
decay and crime, to its current state of a vigorous, optimistic
neighborhood of older middle class residents, small owner run shops,
and residential moderate income tenants who enjoy the ambiance and
charm of one of Saratoga's most historic neighborhoods. We have
shown ourselves over the years to be good neighbors, who take special
care with both the historic renovation of their buildings and the
maintenance and management after completion. We are here for the
long term and provide a stabilizing force for the west side.

We ask that you show the confidence in our ability to carry through
the unique and difficult projects presented as you have done in the
past with our other projects.
We do not present these projects as easy solution to the issues
discussed. We do however feel, that because they represent a unique
solution, that they will be special, and add to the ambiance that has
made our City the special place it is.
