There are still a few issues that need to be clarified prior to issuing the permit. 1. The definition of Habitable Space, as defined by the 2010 Residential Code of NYS, is "a space in a building for living, sleeping, eating, cooking, or used as a home occupation. Bathrooms, toilet rooms, closets, halls, storage or utility spaces and similar areas are not considered habitable spaces. " Based on the photographs you provided, it appears that the walls are sheet-rocked, painted, baseboard installed, carpeted together with a finished ceiling and clearly used for living with a television, tables, chairs, computer, printer, etc. Since it appears to clearly be habitable space, you must meet the light and ventilation requirements for habitable space. Your options are to provide a notarized affidavit that the space is only used for storage, add additional windows or provide artificial light and mechanical ventilation in accordance with Section R303 Light, Ventilation and Heating of the 2010 Residential Code of NYS. 2 still need the area of the habitable space in your basement and the habitable space clearly shown on the , stamped plan. 2. There was no window schedule submitted with your plans. The window schedule includes the manufacturer, rough opening height, rough opening width, sq. ft of glass, sq. of vent, sq. ft egress, clear opening height, and clear opening width. 3. You will provide a verification that the existing home meets the smoke/co detector requirement listed in the 2010 Residential Code of NYS. The remaining issues have been addressed satisfactorily.
