WHEREAS, the appellant having applied for an area variance under the Zoning Ordinance of said City, as amended, to reconfigure the boundaries of the two lots in the Urban Residential - 1 District and due public notice having been duly given of a hearing on said application held on the 4th da Y of June 2003. WHEREAS, after due consideration, the Board makes the following resolution and finding of fact. The area variance for#he following relief: FROM TO 292 Lake Avenue — Minimum mean width 100 Feet 80 Feet Minimum side distance to accessory building 5 Feet 4 Inches 6 Foxhall Drive Minimum mean width 100 Feet 96 Feet . Minimum side yard setback 12 Feet 8.3 Feet Minimum total side yard setback 30 Feet 22.9 Feet Maximum lot coverage 20 % 24.3% Minimum lot size . 12,500 Sq. f=t. 9,539 Sq. Ft. as shown on submitted plans be granted for the following reasons: 1. The applicant has demonstrated that the benefit received from the variance will not have an adverse impact on the neighborhood or on the health, safety and welfare of the community becausethe dimensional relief will not change the_density, usa e or the visual character of the neighborhood. 9 2. The applicant has demonstrated that this action is the minimum variance that would be , necessary and adequate because the side setback re uests ar - q e a result of a pre existing condition and relief from the lot coverage is minimal. 3: There are no other feasible methods by which the applicant can achieve the desired benefit because to meet the lot size, code requirements would place th rear line on the eastern portion of the concrete apron of the pool. 4. The following conditions must be met: - No further subdivision of eifher 292 Lake Avenue or 6 Foxhall drive that makes either lot smaller shall.take place for any reason. , Dated: June 4, 2003 Adopted by the following vote: 4 Ayes; 3 Nays ZONING BOARD OF APPEALa OF THE CITY OF SARA A SP NEW YORK __.d.!
