Male, City Engineer DATE: December 14, 2007 RE: Jelenik Subdivision 143 Jackson Street P.B. # 07.39 The Office of the City Engineer has completed.the preliminary site inspection for the above referenced project. The work has been completed in substantial conformance with the approved site plans with the exception of installing the decorative street lights (the bases, conduit and wiring is complete). A draft as-built drawing has been submitted and the final as-built drawing will be completed once the outstanding work is finalized. I recommend that the existing cash escrow account be released and the Applicant provide a $5,000 cash escrow account or letter-of-credit to cover the installation of the two decorative street lights. The security will be released once the final as-built drawing has been submitted to the Office of the City Engineer and all outstanding inspection fees have been paid. cc: M. Biffer S. WHEREAS,the party of the first part and the party of the second part desire to establish an Escrow Declaration for the purpose of depositing and disbursing funds in connection with proposed on-site and off-site improvements at 143 Jackson Street,in the City of Saratoga Springs,New York, NOW, THEREFORE,the parties hereto agree as follows: 1. Establishment of Escrow Account. In partial consideration for final Subdivision approval granted on April 18,2007 for 143 Jackson Street,Planning Board No. 07-039,the party of the first part shall place into escrow the sum of Thirty Eight Thousand($38,000.00) Dollars for the cost of site improvements at the site known as the 143 Jackson Street Subdivision. 2. Escrow Agent. The Commissioner of Finance of the City of Saratoga Springs, City Hall, 474 Broadway, Saratoga Springs,New York, shall act as Escrow Agent and shall deposit any and all funds received under this Agreement into an interest bearing escrow account at the Adirondack Trust Company with offices located on Broadway in the City of Saratoga Springs,New York. 3. Escrow Fee. The party of the first part shall pay the sum of Three Hundred Dollars and ($300.00)through the City Attorney's Office to the City of Saratoga Springs as an establishment and management fee for this Declaration. 4. Disbursement of Escrow Funds. The City of Saratoga Springs shall in its sole and absolute discretion review and approve or disapprove all of the improvements agreed to by the party of the first part. The City of Saratoga Springs may access at will at any time any or all of the funds held in escrow by the City of Saratoga Springs in order to complete all or any portion of the work agreed to by the party of the first part as identified in the estimate attached hereto and made a part hereof. 5. Interest on Escrow Account. All interest accruing on the Escrow Account shall be for the benefit of the party of the first part and the Escrow Agent is hereby authorized and directed to pay such interest to the party of the first part upon the termination of this Declaration. 6. Termination of Escrow Declaration. This Declaration shall terminate on the 31St day of December, 2008. A "termination event" will require that the City Engineer of the City of Saratoga Springs certify in writing that all of the improvements agreed to by the party of the first part have been completed to his satisfaction and that all as-built drawings have been filed. At the termination date any and all monies remaining in the Escrow Account shall be returned to the party of the first { together with any interest that has accrued and this Declaration shall terminate. 7. Entire Declaration. This Declaration constitutes the entire understanding between the parties with respect to the establishment of this Escrow Account and to the disbursement of escrow funds. This report and inspection dealt with two buildings comprising a single-family residence and a garage. The type of construction is that expected for an older residential building. The building is wood frame construction. Older building material has been used on all interior surfaces. OBJECTIVE The objective of this inspection was to determine the presence of asbestiform minerals in suspect bulk samples. If these minerals are detected, they are identified and quantified. Identification is made as to which mineral and/or minerals are present from the Serpentine or Amphibole groups. These include Chrysotile, Amosite, Anthophylite, Crocidolite, Actinolite and Tremolite. SITE INSPECTION and MATERIAL ANALYSIS Members of the staff of the Harlan-McGee of North America physically inspected each room or habitable space of the structure. Additionally, all accessible areas were inspected. Bulk samples of suspected insulation, mortar, wall/ceiling material, roofing and any other suspected asbestos laden material was collected. Bulk material samples were initially examined and grossly described. All remaining suspect material is then studied under plane-polarized light and orthoscopic illumination to determine refractive indices along specific crystallographic axes and antisotropism. These studies involve immersing the sample in known refractive index liquids and qualitatively determining the mineral types by refractive index, morphology, signs of elongation, birefringence characteristics, and extinction angles. With this information, the mineral type is ascertained. A petrographic point counting technique is then applied to the sample under investigation to quantitatively outline a percent composition of mineral fiber in the matrix of the bulk sample. This counting involves representative sections of the entire material if it is homogeneous. If the entire material under study is heterogeneous, each strata of the sample that can be isolated as a homogeneous section is considered and treated separately. RESULTS OF ASBESTOS INSPECTION Members of the staff of Harlan-McGee of North America conducted the Asbestos Inspection. Material samples were collected by the inspector on the basis of professional knowledge of building materials and known areas of usage for asbestos material.
