The following is my version of interaction with Cliff Van Wagner former chairman
of the Planning Board of Saratoga Springs and my appli Vre. e a BnB permit

1. My lawyer was Dave Harper JUL I.
2018
2. Before the first PB meeting Dave since they w 17r - friends mentioil'efil to
Cliff he had a client wanting a BnB permit
3. Cliff said bring him that is low impact no problem
4. As soon as Toohey stood up and started defaming me for Team Whitney,
Cliff changed is tune and took on my CASE as he called it personally
5. A few days later at a city party function Cliff was defaming me to the mayor
Scott Johnson. Bruce Clements heard the conversation and called me the
next day. Cliff said I was not credible.
6. Cliff/PB I went broke I was too embarrassed and humiliated because my
business went under and I turned to the city and the PB turned on me
because my neighbor was against it
7. I enclosed several documents from other neighbors (22) that where in favor
of my plans. And the city police wrote a memo applauding my concert
parking
8. My Neighbor Cheryl Savage at rt 50 and geyser rd parked back then and
still does and is turning her home into an Airbnb. I don't want to park
9. Phil Klein supplied my dumpster for my parking since 2004 until 2012. Even
thru my case
10.Mike Buffer said I could rent my house for weddings etc. I could work the
event BUT I could not sleep here and I did not stay or work the event.
11.Everybody can park at the track without a permit but I can't
12.Regarding my home occupation, the state of NY labor dept after3 years
agreed I did not have ANY employees ever just contract freelancers.
13.1 was a traveling video guy no one ever came to my house. My freelancer's
car pooled from here
14.Whitney Industries on search engine Manta (see attached) has the home
occupation at 40 Geyser rd. Saratoga Springs employing 20 to 49 people.
Does she have a special use permit for home occupation? It can only be her
and 1 employee than a special use permit. I will file a complaint.
15.In @ 2013 the caretakers house was getting a new septic system. I took
pictures sent them to Dave Harper. He said she needs a permit. I called the
code office and gave them the address no name.
16.Ten minutes later code enforcement calls back and asked in a sheepish
voice if that was Mary lou's property. I said yes, she said no permit.
Construction stopped for a month while they got a permit.
17. Now you all know Tom Lewis who sat on the board. Well after my last
meeting @2013 Tom had lunch with Dave Harper.
18.Tom said lam going to quit the PB
19.Dave said why?
20.Tom said when the board does not like an applicant they will stonewall and
make his life hell. And you client Jon Cromer, they don't like him
21.HOW CORRUPT IS THAT
22.1 qualified then and now for this permit
23.Cliff and Whitney made it personnel
24.1 could have stopped an attack in this city by buying the house 6 months
after 911. I am a Teddy Bear compared to what and who owned this house
before me.
25. The former owners educated their kids at Skidmore in the 80s and went
back to Jordan and this house sat empty for 12 years. I bought it in 2002
and the Mother and Daughter came to move their stuff out.
26.I got them movers with a container to go to Jordan. The movers came to
get me and showed me 2 AK 47s, 8 clips loaded and thousand of rounds of
ammunition under a queen bed. They took their guns back to Jordan. I did
not want them. I called Dave Harper. I called the FBI no one came
27.The mother said she had 2 sons, one was killed in a cafe bombing in
Germany in the 90s. According to the mom Americans hung out at the
café and he was there?????
28.1 also saved a woman committing suicide in my driveway @ 2013. I found a
car in March in my driveway with a woman at 10am pasted out. She had a
half empty quart of grain alcohol on her lap. I called 911 and she was in a
coma for 3 days and if I was not home she would have died.
29.Something happened at work in Scotia and she freaked, her daughter said
she never drank and she drank that half bottle of grain alcohol from Scotia
to my house
30.1 am no threat to Whitney I let them after all this rebuild their stockade
fence from my side because it was easier and cut trees down on my side.
31.Trees we can not cut down without MLW permission even the Springs
townhomes had to fight her to take some trees down. Whitney Industries
main product is Lumber out of the Adirondacks !HI!
32.1 am tired of the discrimination from the PB caused by MLW
33.1 have until Sept 1 to sell or get a permit
34.Ron Kim is handling my Foreclosure and bankruptcy
35.1 have a local bank who has heard this story and his willing to take a loan
app. If I get a permit
36.1 have a horse owner/trainer, home builder that wants to invest
37.When the recession hit my income in 2008 was $1.2 million. In 2009 it was
$170k. I went to the PB for my permit and was turned away from a
CORRUPT BOARD. Things have gotten worse and I am looking into litigation
against the PB, City and Whitney. Defamation and corrupt public officials
are not cool these days
38.My mortgage went from Countrywide to Bank of America. BofA sent me a
modification packet in 2009. I filled it out and sent the first $4,300
39.A few days later I got another mod packet. I called BofA and got out
sourced to India. They said disregard the second and pay the first account
number for 3-month TEST payment.
40.1 did and at the end of three months BofA send me a denial saying I did not
make the 3 TEST payments. They went by the second packet.
41.Then I was in a 3-year fight with BofA and Albany got involved and the CEO
of BofA calls me and said he would look into it.
42.He calls a month later and says there is nothing he can do BofA bundled my
mortgage and sold me to Mellon
43. Mellon took 2 years to contact me and they never offered a mod until last
Aug. But they wanted a 3-month TEST payment. My wife also went thru this
with her Florida house and the Bank still denied her. She is losing her
home too
44.Now the only good thing going poor does is you get Medicaid, Snap and
HEAP. The past 7 years I have had skin cancer, both hips replaced, elbow
replaced. Rotator cuff surgery, Diverticulitis's surgery, hernia surgery, root
canals. I am being treated for psoriatic arthritis and injections in my back.
lost my health insurance and if it wasn't for Medicaid I would be dead.
45.1 am 63 and sent out 60 resumes the past 6 months and 1 have not gotten
an interview
46.The local bank and Dennis Brobston heard this story. The bank said in 30
years of doing business in this town I have never heard a story like yours
and what the PB and Whitney did, frankly I find disturbing. Dennis was a
supporter until Cliff or Toohey got to him.
47.1 ran into Whitney and John at the old Chianti's the week I bought the
house. They where with Ed and Maureen Lewi who I knew from doing the
video for US figure skating. Ed waved and I stopped to say hi and
mentioned to MLW I was her new neighbor. She said she heard it was sold
and asked what I would do there. I said run my video business and maybe a
BnB. She said she had friends that come and would I rent to them. I said I
am a few years from that and 1 would let her know. They toasted me and
said good luck. Now Toohey will deny this conversation but this is how it
went down.
48.Now Cliff, Toohey, PB and City of Saratoga if you want to seal my coffin go
for it.
49.1 will take this to the next level if I have too. I will be 63, bankrupt,
foreclosed, unemployed and homeless by October. And not happy. I have
7,000 Facebook followers from the horse world worldwide following what
is going on.
50.1 am not running an illegal BnB I do not cook or clean or buy my roommates
toilet paper
51.1 have backstretch workers here for every major trainer and I had MLW
exercise rider living here a couple summers ago
52.1 have had 1 guest from Booking a few from Airbnb just like the 5,000
saratogians renting rooms and homes in this city. Even the cities lodging
bureau list the real estate agents doing short term rentals.
53.Here is the breakdown of Saratoga homes on all sites like Airbnb ,home
Away, Home to go, Booking.com Roomster.com,roomates.com, Craiglist,
the Saratogian All the real estate agents and Navy have at least 5,000 in the
city renting something. The city should develop a basic short-term rental
license for home owners and bed tax. I am doing what the city residence
have been doing since the track open 153 years ago. Why am I being
selected for enforcement. If I don't get a permit I am trying to raise money
to move and rent an apt if all this fails. I still have Mellon Bank to deal with
54.My remedy to this situation is to become official so I can join the chamber
of commerce, the tourism bureau and sell meals and beverages to my
guest. No one his asking to be official but me !!!
55.One last thing about my car parking. SPAC started charging for parking the
year after I showed them. I also gave every car a garbage bag and 90% of
the trash was in the bags and in Phil Klein's dumpster while the show was
going on. SPAC should do that.
56.I also gave Marcia the Battle of the Bands idea she did for 2-3 years. She
wanted me to webcasted it for FREE for her
57.The parking lot in front of me by the Springs Townhomes is referred to by
the townhome residents as the URINAL. The 6 port o johns are full in 30
mins and male and females are in the bushes. I had 2 portojohns. If SPAC
was mine MLW and the city and State would shut me down for that.
58.I do have a story in the can with a local news station. They are waiting to
hear the outcome.
59. My other neighbor is Carrie and Cameron Steuert. She in the past came
and complained about me. Then after I gave up in 2013 she called and
asked to cut some trees down on my side of an old stockade fence to put a
new one up. I agreed it would look good with a new one then I called a few
days later and told them it would be easier to unload and build from my
side so they did.
60.The next couple of years we talked periodically about a feral cat she
adopted and we both saw a decline in mice. Then she had 2. I would have
liked to help her with vet bills but I could not afford them anymore for my
lab. She understood I only did the parking because my family needed the
money. She also said IF I ever went back to the PB she would come and
retract the things she said about me because she was wrong. And she said I
was a good man. If she doesn't come to a PB meeting I'm sure she has been
told not to come by MLW
61.I also mow part of MLW lawn along the fence line for 15 years. It is 3 feet
into their property so they can weed trim and repair the chain link fence. It
needs painting.
62.MLW is also complaining about the Microbrewery on Geyser rd because of
loud acoustic music. OMG SPAC is much louder
63. I have backstretch worker room mates not guest. I have had the track
farrier here, a NYRA marketing guy, and I am registered with NYRA
housing. I am registered and inspected by Navy Housing with their smoke
detector etc requirements. This 8 year BnB permit battle is
DISCRIMINATION from a former CORRUPT planning board chairman and a
neighbor who says she wants to be remember for doing nice things for
people.
64. Cliff should be expelled or resign the PB.
65.MLW just leave me and your neighbors alone.
66.Carrie Steuert has told me that John Hendrickson said they would fight me
or anyone trying to do anything back here. I have tried to sell or find
investors. They all ask what will whitney let you do here. My hands are tied
and I have been forced into foreclosure and bankruptcy by whitney and the
corrupt PB under Cliff Van Wagner
67. JoAnn Yepsen knew what was going on and said she would help me get the
permit. But I was out of money until Dennis Brobston offered a 504
program but backed out after MLW got to him.
68.1 have an investor and still am facing discrimination.

As the Traffic Division Sergeant and member of the SPAC Traffic
Taskforce I have had many occasions to work the large-scale concerts
held at the Saratoga rforming Arts Center. at 66 White
Farms Roads serves as an overflow parking tot when all SPAC parking
is filled. Based upon my observations, al • 'ng 66 White Farms Road to
park vehicles will decrease illegally parked vehiclesalong White Farms
Road as well as other areas in the vidnity of SPAC. Illegally parked
vehicles often cause obstruction to traffic and « - - a hazard to
pedestrians walking to the concert venue.

Dear Mr. Van Wagner:
I am writing to you with regards to Mr. John Cromer, a neighbor and resident of 66 White Farms
Rd. I would like to publicly commend Mr. Cromer for the work he has done to save our
neighborhood (The Springs)from the onslaught of concert goers to major SPAC concerts. I have
lived in this neighborhood for more than 17 years and until John moved in we were inundated
with drunk, and disorderly concert goers, especially during the Dave Matthews concerts. They left
garbage in our neighborhood, parked cars everywhere, including our private parking lots and
would attempt to jump the fence to use our locked, private community pool after the concerts.
They would use the bushes along White Farms road as their toilets so it made it very difficult to
walk our dogs during the concerts for fear of what one might see. (SPAC never has enough
portable toilets available so they resort to the bush .)
Since Mr. Cromer has moved into the neighborhood and parked cars on his lawn during these
concerts the damage, inconvenience and traffic in our development has been significantly
reduced. He has, sometimes, more portable toilets available than SPAC and has rules which
need to be followed if someone wishes to park on his lawn. He has garbage cans available and
consequently White Farms Road is not strewn with nearly as much garbage as in the past John
has done our development a great service and made the time of big name concerts easier for all
of us at The Springs.
John has definitely provided The Springs with a welcomed service that has contributed to the
good of our development and provided the community with a welcomed relief from SPAC's lack
of concern.We hope that his efforts are recognized as a positive asset to the neighborhood and
the Springs community.

Dear Mr.Harper:
I am in receipt of your letter,septic system plans,construction estimate and e-mails to me
regarding the options for sanitary sewer service for 66 White Farms Road. As I understand your request,
your client is requesting to install a new septic system in lieu of connecting to the public sewer located
1,648 feet from the site.
I have reviewed the construction estimate as prepared by Travis Mitchell,P.E.and find the
$63,200 total to be a realistic estimate of cost to provide sanitary sewer service to the site. I also reviewed
the septic system plans as prepared by Stephen E Smith,dated November 22,2010 and find them to be
acceptable.
As we discussed,my major concern was how sanitary facilities would be provided during
scheduled outdoor special events. It is my understanding that"special"porta-johns would be provided for
these special events. The cost for the special porta johns and the number of special events was not
provided. My main concern was to compare the cost of the public sewer connection to the cost of the
new septic system plus the cost ofrentals of porta johns for the various special events.
I have no issue with the construction of a properly engineered septic system with the use of porta-
johns as an acceptable alternative to a connection to the public sanitary sewer. As you correctly noted,

this project will require Site Plan approval once a Special Use Permit is issued.

requirements pursuant to said permits,variances and applicable law.

TITLE: Building Permits - Building permits required. Except as otherwise provided in Subsection B of this
section, a building permit shall be required for any work which must conform to the Uniform Code and/or the
Energy Code, including, but not limited to,the construction, enlargement, alteration, improvement, removal,
relocation or demolition of any building or structure or any portion thereof, and the installation of a solid-fitel-
burning,heating appliance, chimney or flue in any dwelling unit. No person shall commence any work for which
a building permit is required without first having obtained a building peuniit from the Building Department.

premises. Said owner has failed to obtain the necessary building permits to alter the structure as

The owner of the premises, JOHN R. CROMER, needs to stop renting any and all sleeping rooms

Saratoga Springs Complete Street Policy Vision (May 2012)
The City of Saratoga Springs Complete Streets Policy will encourage the development of a complete streets
network throughout the City to create a more balanced transportation system. The Policy shall be consistent
with and assist in achieving the goals and recommendations set forth in the City's Comprehensive Plan and
other policy documents. The Policy shall ensure new and updated public and private projects are planned,
designed, maintained and operated to enable safer, comfortable and convenient travel to the greatest extent
possible for users of all abilities including pedestrians, bicyclists, motorists and transit riders.
