McAllister to subdivide his property at 313 Jefferson St. Our property at 1 Daggs Lane borders what is currently the rear of his property, tax parcel#178.52-2-19.112. We have two concerns: (1) Septic: According to public records, this property has private septic. The application states that the "proposed action" will connect to "existing wastewater utilities." We would like clarification of the plans for septic for both the current and proposed lot. The location of the current septic is not shown on the survey. We are concerned that removal of a tank or placement of new tank(s), depending on the location, may destabilize some of the very large trees on the property. (2) Potential future construction: The proposal requests a rear yard setback variance for the existing house because the side of Lot#1 becomes the back with the subdivision. If granted, our property would be adjoining the side rather than the rear of proposed Lot#1, where only an 8' setback is required. We have no issue with the current house in its current location. However, if the property were to be sold, it is quite likely that the existing home would be expanded or torn down and replaced with a larger structure. If the variance also applies to any new or expanded structure, the new house could potentially be much closer to us. For example, if a 60' house was built 8 feet from our fence, it would be a significant change in our view and sunlight. Therefore, we request that if any variance is approved, it only apply to the existing house with its current footprint, and that any new construction (expansion or replacement)be subject to the current rear setback requirement(i.e., 25').
