HomeMy WebLinkAbout20200138 Gersin Shed Correspondance (3) ZBA Application RE:20200138 - Gersin Shed Dear Board, My wife and I own parcels 179.4-2-35 and 179.4-2-36, also known as 14 Echo Ridge Drive. We would like to clarify some of the issues raised at the July 2 meeting. This is most easily done by sharing with the board the sections from the Interlaken- Zone C site plan dated 9/1/98. Additionally, it is important to note that this site plan is a part of the HOA documents. The sections are all pertinent to the questions the board asked. We have also included a few photos taken of the area. The first attachment includes four sections from the site plan which clearly state the restrictions of the "No-Cut" buffer and the responsibility of the HOA to enforce the same. The next attachment contains three photos which show the clear contrast between the neighborhoods, Summer Wind and Echo Ridge Drive, and the appearance of the "No-Cut" buffer in its unadulterated state. If the board compares the photo provided by the Gersins of their garden it is clear that the shed area has been cleared in the "No-Cut" buffer to accommodate the placement of the shed, further compromising the "No-Cut" buffer. The last attachment is an email from Ron Phillips to Stephen Shaw, formerly the head of Building and Zoning, dated May 12, 2015 establishing a time frame when we began questioning that the shed was in the "No-Cut" buffer. Accessory Buildings - Accessory permitted uses ( Storage sheds, swimming pools, solar/heating/ventilation equipment, antennas and satellite dishes, greenhouses (non-commercial) , pool cabanas, picnic pavilions, etc. ) shall be permitted on each building lot subject to the following conditions: i., nsc1 .aiLL . setbrsc]ca: 1 ) Front = 35 feet 2 ) Side = 5 feet 3) Rear = 5 feet B)' Minimum distance from principal structure = 5 feet C) Maximum building size = 160 sq.ft. D) No accessory structure shall be located 'within the "no - cut" buffers . I 1. No-Cut Buffers - Deed restrictions shall only allow removal of healthy vegetation under 5" diameter, measured at breast height. Noxious, dead, and potentially harmful vegetation may be removed, reguardless of size, with appropriate H.O.A. authorization. Six building lots, as listed below, shall have additional vegetation removal restrictions: Lots 4,6,8,10, and 12 Sundance Drive and lot 2 Cassidy Drive shall allow limited removal of vegetation (of any size) in the "no-cut" buffer to allow and promote re-vegetation of the buffer area. Upon re-establishment of an adequate buffer, the general no-cut buffer restrictions shall apply. Additional regulations concerning the H.O.A. are listed below: The H.O.A. will carry out maintenance and enforcement of No-Cut Buffers. Only property owners in this phase of Interlaken may become members of the H.C.A. and have use of the facilities in this phase. There shall be no covenants on the maintenance of the exterior of the homes in this development. The owners of that property,9 Waterview,Sue and Jim Gershin,have been progressively encroaching the protected wooded zone with gardening,fencing and other landscape decoratives as well as a large shed.Most recently they surveyed to determine where a fence can be placed in the back of their home,which is a part of the no cut/Green Zone.The intent of this fence is not clear,but the owner has stated she is creating a dog run/kennel area. The map I have attached was given to me by our neighbor Elizabeth Merena(Breedlove)who negotiated the no cut zone with the developer of Summer Wind.She is certain that the zone can not be used for any personal purpose or altered in any way based on that agreement. As you can see from the map,there is a 40 foot minimum no cut following all property lines on the Echo Ridge side. Please advise what your findings are relative to the issue described as soon as possible as the owners of 9 Waterview are moving along with their plans. Very truly, Ron Phillips 954.830.7247
