I hope this email finds you well.
We received the notification for an area variance for 54 Granite Street (Brackett Lane) for an
accessory structure because the project will result in non-compliance with the 25% required
permeable coverage. It is unclear to me why this isn't a use variance request? The structure is being
built as a habitable space with a bathroom so, to me, this is more than an accessory structure. They
even say in the application that friends and relatives will be staying there on occasion.
I looked at the USDO and the type of project they are proposing would be allowed in the UR-3 with
the appropriate supplemental regulations and site plan review. I agree with that approach as it gives
the PB more oversight into the organization of the use on the lot. As proposed as a variance request
this oversight is not occurring.
Plus, as with many communities that are destinations, the Air BnB/short term rental situation is
becoming increasingly real. If the Horan's build this it can easily be rented as such and I don't believe
that there is ample space left on the property to accommodate extra parking, guests, etc.
I'm not sure what the answer is here yet but I think looking at it as a use variance would be a first
step. Or, asking them to wait until the USDO is adopted.
Finally, do you know if the City is looking at a rigorous short term rental registration law? Lake Placid
and North Elba just adopted one and it is very thorough. I could see needing something like this here.
