ZBA Application RE:20200138 - Gersin Shed
My wife and I own parcels 179.4-2-35 and 179.4-2-36, also known as 14 Echo Ridge Drive.
Our property abuts the No-Cut Buffers of 7,9,11,13,15,17,19 Waterview Drive. The applicant owns 9
Waterview Drive.
At the time the applicant sought approval for installing the shed my wife owned 11 Waterview, next
door to 9 Waterview, in addition to our current property, 14 Echo Ridge Drive.
To address the statement raised by the applicant that we originally agreed to the placement of the
shed:
We assumed that the shed would be in a compliant location on the property and not in the No-Cut
Buffer. We took comfort in knowing that the HOA was responsible for the maintenance and
enforcement of the No-Cut Buffers per the Interlaken Zone C Summer Wind site plan, therefore we
had no reason to object to a neighbor wanting to install a shed. The HOA's responsibility is clearly
stated on the site plan.
Subsequently the Gersins installed a fence in what we suspected was located in a part of the No-Cut
Buffer. After much research and consulting with attorneys over several years we realized that the shed
and trees removed to make way for the installation of the shed were in fact in the No-Cut-Buffer and a
clear violation of the site plan.
The resident, Summer Wind HOA board members and their lawyer were advised of the violation.
They all chose to ignore the violation.
The protection of this No-Cut Buffer is essential to maintaining the visual and noise barrier that it
provides between the residents of Echo Ridge Drive and the residents of Summer Wind.
We ask that the ZBA stand by the site plan by denying this request for an after the fact variance.
