Our interest in this application lies in the fact that four parcels on Waterview Drive are located along one of our property lines. Four of our five neighbors who live on our private road also have Waterview Drive parcels backing up to their property. In fact, all Waterview Drive-odd numbered homes back up to other parcels not part of the Interlaken Zone C- (Summer wind HOA). We believe that it is essential that the ZBA maintain the integrity of the Approved Site Plan adopted by the Planning Board on 1/15/97. We are particularly concerned as to whether the Applicant and/or the HOA have violated the clearly stated "Notes"; #11 NO-CUT BUFFERS.The respective buffers have been clearly defined and delineated. No doubt they are incorporated as part of each homeowner's Deed Restrictions. A No-Cut Buffer inherently protects the "rights" of other property owners. Infringements are not acceptable. Is the shed situated within the No-Cut Buffer? We would ask that the ZBA not dilute the spirit of the initial Site Plan Approval by granting a self- inflicted need for a variance. No cut buffers were an integral part of the initial approval. Buyers should clearly have been aware of the limitations for use. A review of the Site Map shows a buffer of 50' along our property line and then ranging from 30'up to 100'for our neighbors.The potential for future VIOLATIONS exits within this HOA unless it is made perfectly clear that such violations will under no circumstance be tolerated now and in the future.
