NOTICE OF DECISION
In the matter of the application #20190604
ROBIN LAUDER LLC D/B/A THE CLUETT HOUSE BED&BREAKFAST
2 CLEMENT AVENUE
SARATOGA SPRINGS, NY 12866
Involving the premises with tax parcel #165.35-2-17, in the City of Saratoga Springs, on an application for a
special use permit for a Neighborhood Bed & Breakfast in the Urban Residential— I District.
In accordance with 6 NYCRR Part 617.5,the Planning Board classifies this action as Type II and exempt from
further SEQRA review.
Having properly noticed and conducted a public hearing on July 25, 2019 as required; the public hearing was
continued and closed on November 7, 2019 on the proposed use.
The Planning Board denied the requested special use permit for a neighborhood bed and breakfast on November
7, 2019. The Planning Board's decision was appealed by the applicant and subsequently annulled by the Supreme
Court, which ordered issuance of the special use permit, with applicable conditions.
The Planning Board reconsidered the application on May 14, 2020 and upon evaluation of the application based
on the City's enumerated criteria to ensure that the proposed use will not adversely affect surrounding
properties and community character;
And, in accordance with requirements set forth in the City Zoning Ordinance, chapter 240, article 7.I "Special
Use Permit",the Planning Board issues the following decision on June I I, 2020 (passed 7-0-in favor: Torpey,
Horton, Fabozzi, Boivin, Bonitatibus, Mayo,Jenks):
Eel Approve a 5-year renewable permit for a five-room bed and breakfast with the following conditions:
I. The term of the renewable permit will begin at the issuance of the required lodging license by the
Accounts Department.
2. Applicant shall submit an application to either renew the permit or for a permanent special use permit
within 3.5-years after implementation of the permit.
3. No more than 12 catered events within a I 2-month period shall be held on the premises. Such events
shall be hosted by a guest staying at the bed and breakfast.
4. No guest shall host more than 3 (of the 12) of the catered events within the I 2-month period.

5. All events shall be held indoors including on the front porch. No events shall be held on the lawn or in
the parking area.
6. Outdoor gatherings shall end at I Opm.
7. There shall be only one kitchen within the residence; there shall be no private kitchen in the resident
manager's quarters.
8. The property shall not be used as a short-term rental nor shall individual rooms be rented prior to
issuance of the lodging license.
9. No over-sized trucks for regular deliveries to the property shall be allowed.
10. Parking for the guests and the resident manager shall be accommodated on the property.
I. Site signage shall be limited to that which is permitted by the zoning ordinance. Directional signage shall
be placed to control traffic flow for the driveway and parking area.
12. House rules shall be placed in all guest rooms and shall be submitted with the lodging license.
13. Site plan review is waived with the issuance of the renewable permit provided that the site is developed
per submitted schematic parking plan, dated September 9, 2019.
14. Site plan review shall be required if an application is made for a permanent special use permit with
installation of a sidewalk along Clement Ave. frontage to be further considered at that time.
15. The resident manager shall maintain sufficient records to ensure continuous compliance with all
conditions and to facilitate any necessary enforcement.
