I do not believe that this application, as configured, is necessary as I have submitted to the City ample proof, that was accepted by the Planning Board, that this real estate is supposed to be two(2)individual parcels of land. If that is true and is accepted by the City, as we requested in November of 2019, then there are several Area Variances in this Amended Zoning Application that are not necessary. However, my clients want this matter to be heard and creating this new full Application was the only way I knew to have it addressed. If anyone would like to talk about this Application, I would be more than willing to do so. Otherwise, please place us on the soonest available Zoning Board agenda. That the variance, if granted, will not alter the essential character of the neighborhood. Changes that will alter the character of a neighborhood or district would be at odds with the purpose of the Zoning Ordinance. The requested variance will not alter the character of the neighborhood for the following reasons: 4. That the alleged hardship has not been self-created.An applicant(whether the property owner or one acting on behalf of the property owner) cannot claim "unnecessary hardship" if that hardship was created by the applicant,or if the applicant acquired the property knowing(or was in a position to know)the conditions for which the applicant is seeking relief. The hardship has not been self-created for the following reasons: Revised 01/2019 ZONING BOARD OF APPEALS APPLICATION FORM PAGE 6 AREA VARIANCE—PLEASE ANSWER THE FOLLOWING(add additional information as necessary): The applicant requests relief from the following Zoning Ordinance article(s) Article 2.0 Table 3 Dimensional Requirements From To SEE ATTACHED LIST BROKEN DOWN FOR 59 FRANKLIN STREET AND 11 CHERRY STREET Other: THE BUILDING ON FRANKLIN STREET HAS BEEN IN ITS PRESENT POSITION SINCE THE 1800'S.AS THE RESIDENCE ON CHERRY STREET IS ON AN ALLEY, IT HAS ONLY ONE FRONT WHICH IS CHERRY STREET. To grant an area variance, the ZBA must balance the benefits to the applicant and the health, safety, and welfare of the neighborhood and community, taking into consideration the following: I. Whether the benefit sought by the applicant can be achieved by other feasible means. Identify what alternatives to the variance have been explored (alternative designs, attempts to purchase land, etc.)and why they are not feasible. ALL OF THE AREA VARIANCES FOR THE BUILDING ON 59 FRANKLIN STREET ARE PRE-EXISTING.THE PARKING VARIANCE IS NOT REQUIRED FOR THE 2 APARTMENTS. THIS IS A PERMITTED OFFICE BUILDING AND THERE IS NO LOCATION FOR THE OFFICE PARKING SPACES THAT CAN BE ESTABLISHED WITH THE REQUIRED SETBACKS. 2. Whether granting the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Granting the variance will not create a detriment to nearby properties or an undesirable change in the neighborhood character for the following reasons: PLEASE REVIEW THE VARIANCES THAT WERE GRANTED FOR THE RESIDENCE AT 60 FRANKLIN STREET AND AT 66 FRANKLIN STREET. ALSO NOTE THE LACK OF SETBACKS ON THE TOWNHOUSE PROJECT DIRECTLY WEST AND ACROSS THE ALLEY FROM 11 CHERRY STREET. THE DESIGN REVIEW COMMISSION FOUND THE POSITIONING OF THE NEW HOUSE ACCEPTABLE AS DID THE PRESERVATION FOUNDATION. Whether the variance is substantial. The requested variance is not substantial for the following reasons: THE AREA VARIANCES PERTAINING TO THE 59 FRANKLIN STREET BUILDING REPRESENT ITS PRE-EXISTING, NON- CONFORMING LOCATION SINCE THE 1800'S.THE FRANKLIN STREET PROPERTY AND THE 11 CHERRY STREET PROPERTY ARE NON-CONFORMING LOTS PURSUANT TO SECTION 5.5 (B)OF THE ZONING CODE. PURSUANT TO SECTION 5.5 (C)OF THE ZONING CODE, A SINGLE FAMILY HOME MAY BE CONSTRUCTED ON THE CHERRY STREET PARCEL. THE LAW OFFICE IS A PERMITTED USE AT 59 FRANKLIN STREET, THUS THE PARKING OF CARS MUST ALSO HAVE BEEN ANTICIPATED. 4. Whether the variance will have adverse physical or environmental effects on neighborhood or district. The requested variance will not have an adverse physical or environmental effect on the neighborhood or district for the following reasons: THE BUILDING ON 59 FRANKLIN STREET HAS EXISTED FOR MORE THAN 100 YEARS. ITS USE AS TWO APARTMENTS AND AN OFFICE HAS BEEN APPROVED FOR 35 YEARS WITH NO ADVERSE AFFECT ON THE NEIGHBORHOOD. THE RESTORATION OF A SINGLE FAMILY HOME ON 11 CHERRY STREET WILL BE CONSISTENT WITH THIS HISTORIC NEIGHBORHOOD. THE INCREASE IN THE DENSITY OF THIS AREA OF THE CITY HAS HAD NO ADVERSE IMPACTS ON THE NEIGHBORHOOD. 5. Whether the alleged difficulty was self-created(although this does not necessarily preclude the granting of an area variance).Explain whether the alleged difficulty was or was not self-created: IT IS NOT A SELF-CREATED HARDSHIP. IT IS A PROBLEM CAUSED BY THE COUNTY OF SARATOGA ACQUIESCED IN BY THE CITY WHEN THEY MERGED 11 CHERRY STREET AND 59 FRANKLIN STREET. That information is submitted with this Amended Application and was submitted with this Application. It is my position that the DeValls do not need to seek subdivision approval from the Planning Board of the City of Saratoga Springs as they are the owners of two (2) individual lots whose existence dates before the beginning of the last century. The fact is, that the City of Saratoga Springs or the County of Saratoga unilaterally merged these two (2) lots into one tax parcel, that being Tax Parcel No. 165.59-1-54. That merger took place without the request or permission of the property owners and without any deed or documentation that would have merged the two (2) lots or sought to have the City/County perform the merger of these two (2) parcels. According to the City Attorney, there is no "Merger" provision in the City Statutes or Code which would have authorized the governmental merger of these two lots. I have sought clarification as to this subdivision question from several sources within City Hall, but I have not gotten a response. 1 As we will demonstrate below and in the attached documentation, the two (2) lots, pursuant to Section 5.5 of the Zoning Code of the City of Saratoga Springs, are pre-existing, non-conforming lots and as a result, the Lot to the west and rear of 59 Franklin Street, historically known as 11 Cherry Street, may have a single family residence constructed on that parcel. (Zoning Code Section 5.5B, C, D) Based on the lack of response from City Officials with regard to the subdivision question, I am forced to submit an area variance request for both 59 Franklin Street and 11 Cherry Street in spite of the fact that it is not required. The proof of this is as follows: I. Deeds (All referenced Deeds are attached as Exhibit"A") All deeds have the same description of the two (2) lots or the lots as they appear on the individual deeds. A. Deeds conveying both lots with each lot individually described. 1. DeVall from Gailor 1994 Book 1400 page 303 2. City Assessors Map Exhibit Attached is a portion of the City Assessor's Map from approximately 1940 — 1960. The two subject properties were: 59 Franklin Street Section 10 Block C Lot 1 11 Cherry Street Section 10 Block C Lot 2 This configuration matches the deed descriptions for the two (2) parcels. 3 III. City of Saratoga Springs Tax Rolls 1940, 1950, 1959 Exhibit"C" These Tax Rolls when compared with the above City Assessors Maps show two distinct parcels of property at 11 Cherry Street and 59 Franklin Street. These lots pre-existed modern zoning in the City of Saratoga Springs. IV. Sandborn Maps from 1884, 1889, 1895, 1900, 1954 Exhibit "D" These Maps show the existence of two (2) separate buildings on the subject lots both marked "Dwg" for Dwelling. V. Manning's Saratoga Springs Directory 1960—59 Franklin Street Exhibit"E" Show the structure at 59 Franklin Street to be occupied in 1960 by at least three individuals; James H. Fishback, Charles H. Blanchard and Grace G. Fisher. VI. Manning's Saratoga Springs Directory 1960— 11 Cherry Street Exhibit"F" Shows the structure at 11 Cherry Street to be occupied in 1960 by at least three individuals; Wayne D. Bishop, Merle E. Howroyd and Theodore R. Mabb. VII. VII Pictograph of Saratoga Springs in 1888 Exhibit"G" There are many copies of this Pictograph of the buildings and structures that existed in the City in 1888. In the picture of the full print, you can make out the Grand Union Hotel on the side of Broadway. In the closer pictures of the neighborhood in question"Franklin Sq"is clearly marked and to its left in the middle of the picture are the two Greek Revival Structures being 59 Franklin Street, the DeVall property 4 are the two Greek Revival Structures being 59 Franklin Street, the DeVall property and 63 Franklin (Tax Parcel No. 165.59-1-55). The street facades of those buildings have not changed. Please look to the rear of the 59 Franklin Street, which is the corner property. There is a structure which I assume is the dwelling that is represented in the Sanborn Maps (Exhibit"D") Finally, attached is a graphic, but to scale, depiction of the two (2) lots: 59 Franklin Street and 11 Cherry Street. (Exhibit"H") On the right is a calculation of the square footage of the two (2) lots taken from their pre-zoning deed description showing a total of 12,133 square feet. Below that is the 12,125 square foot calculation that is taken from the subdivision survey shown in Exhibit"I" and is the plan from which all of the area variances are calculated. The difference in the size of the combined lots from the old deeds to the new survey is (8) square feet. (12,133 sq. ft. — 12,125 sq. feet= 8 sq. ft.) A statistically irrelevant number. The difference is the 11 Cherry Street lot is 192 square feet less or a 3.67% deviation and the 59 Franklin Street lot is 188 square feet greater or a 2.4% deviation. The purpose of this calculation is to demonstrate that the proposed subdivision will bring the two lots back to the approximate size they were prior to zoning in the City of Saratoga Springs. 5 Significant Zoning Area Variances were granted relatively recently for the new residential structures at 66 Franklin Street and 60 Franklin Street,Exhibit"J"These properties are directly across the street from 59 Franklin Street. As a result, we are seeking a written opinion from whatever person or department would be responsible for issuing such a written opinion, that my clients do not need a subdivision of their land and although an area variance(s)may be need with regard to 11 Cherry Street upon granting an area variance, they have a right to construct a single-family residence on that property. Because we have had no response to this inquiry,we have submitted the Amended Zoning Application. 6 rE\\J/ [ flpflLj 77 zLrUJLL L /IA\ PP - - - ov-z R & R:? c41a et f Teem 4014 Fbe 4,/ 16 etni Ma. 144-e, WARRANTY DEED WITH LIEN COVENANT Sbt NA POP'sMAls THIS INDENTURE made the 22nd day of November, Nineteen Hundred and Ninety-Four BETWEEN: ERNEST J. . The appellant having applied for an area variance under the Zoning Ordinance of said City to permit the construction of a single family residence and detached garage in a UR-4 district and public notice having been duly given of a hearing on said application held on the 11th and 25th of January, 2016. In consideration of the balance between benefit to the applicant with detriment to the health, safety and welfare of the community, I move that the following area variances for the following amount of relief: Required: Proposed: Total relief requested: Minimum average lot width: 100 feet 62 feet 38 feet (38%) Minimum front yard setback: 25 ft. 7.5 ft. 17.5 ft. (70%) Minimum side yard setback: 20 ft. 3 ft. 17 ft. (85%) Minimum side yard setback: 20 ft. 17 ft. 3 ft. (15%) Minimum total side yard setback: 45 ft. 20 ft. 25 ft. (56%) Maximum principal building coverage: 25% 25.31% .31% (1%) Minimum rear yard setback: garage 5 ft. 2 ft. 3 ft. (60%) Minimum side yard setback: garage 5 ft. 3.5 ft. 1.5 ft. (30%) As per the submitted plans or lesser dimensions,be approved for the following reasons: 1. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant. The applicant considered repositioning the garage; however this created a difficult entrance/exit to the garage given the limited space at the north end of the property. 2. The board notes that granting this variance will not create an undesirable change in neighborhood character or detriment to nearby properties. The application states"A single family lot of this size is consistent with the neighboring property and the variance that was granted by the Zoning Board of Appeals for the lot[directly] to the south on July 27, 2015."Also,the application included a portion of the tax map which shows the majority of the lots in the neighborhood are under the required 100' average lot width. 3.All areas of relief requested may be considered substantial; however, the existing parcel is pre preexisting nonconforming and is similar to other lots in the neighborhood. 4.The board concludes this variance will not have significant adverse physical or environmental effect on the neighborhood or district. The amount of the site to remain permeable, as identified on the submitted survey,is 44%,which is in excess of the required minimum 15%. The appellant having applied for an area variance under the Zoning Ordinance of said City to seek additional relief for a single-family residence in a UR-4 District and public notice having been duly given ofa hearing on said application held on the November 7`''and December 12`'', 2016. In consideration of the balance between benefit to the applicant with detriment to the health, safety and welfare of the community, I move that the following area variances for the following amount of relief: Required: ( Previously Proposed: Total relief Total relief requested: Minimum average lot width: 100 feet approved: No change previously No additional relief 55.4 feet approved: required L J No change Maximum principal building 25% 31% 36.2% 6 ft. (68%) setback: I _ As per the submitted plans or lesser dimensions, be approved for the following reasons: I. The applicant has demonstrated this benefit cannot be achieved by other means feasible to the applicant. The applicant states "there is no feasible means to provide relief from the as built condition." 2. The board notes that granting this variance will not create an undesirable change in neighborhood character or detriment to nearby properties. From the previous application for relief on this property, the Board noted: "The applicant furnished information on lot and home widths in the neighborhood; the Board concluded that this proposed lot line adjustment and residence construction would be consistent in scale and size with the other homes around it on both sides of Franklin Street." The relief currently requested is largely associated with overhangs and block escape wells, all of which, in relation to the as built construction and the neighborhood, will have a minimal negative impact on neighborhood character and nearby properties. 3. The Board notes this variance could be considered substantial in total; however, the modifications for the as built condition are not substantial. 4. The board concludes this variance will not have significant adverse physical or environmental effect on the neighborhood or district. 5. The alleged difficulty is self-created, but this not necessarily fatal to the application. Adopted by the following vote: AYES: 6 (B. Moore, K. Kaplan, G. Hasbrouck, S. Carlson, S. Steer, C. Grey) NAYES: 0 Dated: December 12, 2016 C•. This variance shall expire 18 months following the filing date of such decision unless the necessary building permit has been issued and actual construction begun as per 240-8.5.1. . 044:44* 12/22/16 Date Chair I hereby certify the above to be a full, true and correct copy of a resolution duly adopted by the Zoning Board of Appeals of the City of Saratoga Springs on the date above mentioned, six members of the Board being present. e, '
