SQUILLACIOTI RESIDENCE
IN THE MATTER OF THE APPEAL OF
Leonard and Carol Squillacioti

from the determination of the Building Inspector involving the premises at 25 Horizon Drive the City of
Saratoga Springs, New York being tax parcel number 192.8-I-I on the Assessment Map of said City.
The appellants having applied for an area variance under the Zoning Ordinance of said City to permit the
construction of a 3-season sun porch in the Water's Edge/Woodlands PUD and public notice having been duly
given of a hearing on said application held on the 18th day of May through the 8th day of June 2020.
In consideration of the balance between benefit to the applicants with detriment to the health, safety and
welfare of the community, I move that the following area variances for the following amounts of relief:

As per the submitted plans or lesser dimensions, be approved for the following reasons:
. The applicants have demonstrated this benefit cannot be achieved by other means feasible to the
applicant. The applicant has demonstrated that alternative locations and layouts would not provide the
desired benefit, as it would result in significant additional expense and interrupt the current floorplan of
the home as it would not align with the rear egress of the residence. The applicant states that the sun room
would also be located on the northeast side of the residence,which would result in poor sun exposure, thus
defeating the purpose of the room. In addition,the applicant's angled lot line causes greater relief to be needed
at only a portion of the requested sunroom extension. Furthermore,the applicants have demonstrated that
the proposed sunroom addition will, in essence, lay in the same footprint of the existing patio structure.
2. The applicants have demonstrated that granting this variance will not create an undesirable change in
neighborhood character or detriment to nearby properties. The applicants have demonstrated that a 20
foot natural and protected vegetative barrier exists between the applicant's lot and the adjacent lot,which
provides for greater privacy between the properties. Moreover, other adjacent properties have similar
encroachments into the setback as that which is requested by the applicant.
3. The Board finds the lot coverage variance to be substantial on a percentage basis, but this is mitigated by
considering the protected barrier between the applicant's property and the adjacent property to the rear.
4. These variances will not have a significant adverse physical or environmental effect on the neighborhood or
district. The proposed sunroom will lay in the same footprint as the existing patio structure.
5. The alleged difficulty is self-created insofar as the applicants desire to expand the proposed accessory
structure, but this is not necessarily fatal to the application.

This variance shall expire 18 months following the filing date of such decision unless the necessary building
permit has been issued and actual construction begun as per 240-8.5.1.

of Appeals of the City of Saratoga Springs on the date above mentioned, six members of the Board being
present.
