NOTICE OF DECISION
In the matter of the application #20200188
Chow Bella
50 West Ave.
Saratoga Springs, NY 12866
Involving the premises with tax parcel #165.14-1-41, in the City of Saratoga Springs, on an application
for a Permanent Special Use Permit for up to 7,500 sq. ft. within an existing building for retail sales,
service establishment, and eating and drinking establishment uses within the Transect-5 Neighborhood
Center District.
In accordance with 6 NYCRR Part 617.5, the Planning Board classified this action as a Type II action and
therefore, exempt from further SEQRA review.
Having properly noticed and conducted a public hearing on May 14, 2020 as required and continued to
May 28, 2020 on the proposed uses;
And, upon evaluation of the application based on the City's enumerated criteria to ensure that the
proposed use(s) will not adversely affect surrounding properties and community character;
And, in accordance with requirements set forth in the City Zoning Ordinance, chapter 240, article 7.1
"Special Use Permit", the Planning Board issues the following decision on May 28, 2020 (passed 7-0-in
favor: Torpey, Horton, Fabozzi, Boivin, Bonitatibus, Mayo,Jenks):
Eel Approve with the following conditions:
I. Any combination of retail sales, service, and eating and drinking uses not to exceed required 13
parking spaces on site.
2. No outdoor uses permitted.
3. Signage in the building and in the rear of the property stating that dogs shall be leashed
outdoors and no outdoor use of the property permitted noting the presence of wetlands.
4. Striping of the parking lot as shown on the submitted plan.

5. Installation of planter boxes along the frontage of the property and in front of the building as
shown on the submitted plan.
6. Installation of down-cast cut-off building-mounted lights in accordance with the submitted
lighting plan.
7. Hours of operation: 9am —8pm
8. Waiver of site plan review granted provided that the site is improved in accordance with the
submitted site plan.
Note: this approval shall expire 18 months from the issuance date unless all conditions have been
complied with and actual work begun.
