' . The Qepartment of Environmental Conservation (DEC) has determined that your
proposal to sub-divide and deve]op the above-described parcel in the City of Sarataga
Springs is not likely ta result�in the take of threatened or endangered species. This
� determination is based on a review of the site by staff from the Division of Fish and �
Wildlife. Though�Karner Blue {Lycaeides Melissa)and Frosted elfin butterflies .
� (Callophrys iris) are known to occur near your project location, there is no habitat on the
subjset parcea and the DEC does not anticipate your proposed action to result in a take.
Therefore, na permit is required at this time pursuant to the implementing regulations
(6NYGRR Part 182) of the New Yark State Endangered Species Act (Article 11-0535).
Be advised that any changes in location, expansian of the footprint of the project,
modifications of the scope, or changes in the timing of proposed actions that are not
identified i�n the submission referenced above may_trigger DEC authorization. Pdease
reinitiate contact with this affice if such activities are contemplated.
Please note that this letter does not relieve you of the responsibility of obtaining
