Two Clement is at the southeast corner of Clement and State Street. One house separates my house from the applicant's premises. Pursuant to Judge Crowell's decision the application has been remitted to the Planning Board for issuance of the application and "consideration of any applicable conditions." I would ask the board to consider and impose conditions, some of which were conceded by the applicant during the previous three hearings before the Planning Board. First, the proposed Clement Street entrance to the Bed And Breakfast is directly across the from and south of the City-owned and -operated children's playground at North Side Park located at Five Clement Street. There is neither a sidewalk on the north side of the applicant's property nor on the south side of the playground. This poses a danger to children and pedestrians. The land just to the south of the playground is sloped and may not suitable for the construction of a sidewalk but if feasible this would seem to be a mitigating factor, as immediately west of the playground is a small parking area for two vehicles and to the west of this small lot is a sidewalk that runs the length of the North Side field. Accordingly, a sidewalk along the southern edge of the playground would connect to the parking area and tie into the sidewalk that runs east-west along the North Field. The issuance of the SUP should be conditioned on the applicant's paying for the installation of a sidewalk along the south side of the playground. Second, there is no sidewalk along the north side of the applicant's property, and there should be for multiple reasons such as creating a pedestrian-friendly city. Third, the applicant has represented that the Bed and Breakfast is to be operated April 1 to October 31 of each year. The issuance of the SUP should be conditioned upon this period of operation. During the offseason, no one other than a caretaker and the caretaker's immediate family who occupied the premises during the period of operation may reside at the premises. Fourth, there shall be no outdoor gatherings beyond the paying occupants of the premises. Fifth, there shall be no commercial activities beyond the scope of the rent charged for the room and food included in the room charge so as to preclude catered events whether catered by the applicant or a third party vendor. Fifth, there shall be no off street parking. Sixth, no additional outdoor lighting is to be installed. Seventh, no portable or temporary bathroom facilities (such as Port-a-Johns) shall be permitted. Eighth, no tents or other temporary structures shall be permitted. Ninth, the SUP should be approved for one year so as to require the applicant to reapply to demonstrate compliance with the imposed conditions and to otherwise evaluate the use as a Bed and Breakfast.
